In accordance with Chapter 6, Section 2(m) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by Hilcorp Energy Company to remove the requirement of caustic scrubber control for the sulfur pit vent (WSC001) at the Carter Creek Gas Plant, located in the NE¼ of Section 6, T18N, R119W, approximately twenty-one (21) miles north of Evanston, in Uinta County, Wyoming.

Second Regular Meeting

July 18th, 2023

The official record of proceedings of the second regular meeting of the Evanston City Council for the month of July was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live.

Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag.

The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, Jesse Lind, Evan Perkes, David Welling, Mike Sellers and Jen Hegeman. 

Staff members present at the start of the meeting were: City Attorney/Prosecutor, Mark Harris; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Information Technology Coordinator, Preston Sheets; Public Works Director, Gordon Robinson; Police Chief, Mike Vranish; Director of Parks and Recreation, Kim Larson; Director of Engineering and Planning, Dean Barker and Community Development Director, Rocco O’Neill.  A group of interested citizens was also present.

Council Comments

Council member Perkes apologized for missing a few meetings recently.

Council member Sellers thanked the Fire Department for their quick response to a fire in his neighborhood. He also commented that the Lottery is up and there will be a lot of traffic and people in town.

Council member Welling thanked Rocco O’Neill, Community Development Director for organizing the meeting and tour of Evanston for the Business Council Insite Selection Team. He mentioned that they were impressed with Evanston.

Council member Hegeman reminded everyone to support the businesses on Lincoln Highway.  She commented that they will be struggling due to the cancellation of the Rodeo Series this summer. She reminded everyone that the Golf Tournament Fund Raiser for the Steam Engine 4420 was this weekend and encouraged everyone to attend.

Consent Agenda

Council member Welling moved, Council member Lind seconded, to approve the following Consent Agenda Items:

Street Closure requested by Kayann Smith of First Bank for a Customer “Big Day” Event on Friday, August 4th, 2023 on 10th Street from Main Street to Center Street; from 8:00 am to 4:00 pm.

Department Comments

Community Development Director, Rocco O’Neill thanked the City Departments that helped with Brewfest.  He also expressed appreciation and gratitude to Engineering/Planning and Public Works for assisting with the Insite Select Team’s visit.

STUDENT DIRECTORY INFORMATION

To All Interested Persons:

PLEASE TAKE NOTICE that Uinta County School District Number One, State of Wyoming, may designate certain personally identifiable information as directory information for the school year 2023-2024. The District intends to designate student names, addresses, telephone numbers, date and place of birth, major fields of study (if applicable), participation in officially recognized activities and sports, weight and height of athletic team members, attendance dates, degrees and awards received and the most recent previous educational agency or institution attended by a particular student as directory information for students enrolled in the District.

PLEASE TAKE FURTHER NOTICE that any parent, guardian or legal custodian of a student enrolled in Uinta county School District Number One, State of Wyoming may refuse to permit the designation of the above-entitled categories of personally identifiable information with respect to a particular student as directory information provided that such parent, guardian or legal custodian of the student inform the Superintendent or designee, Uinta County School District Number One, Evanston, State of Wyoming, in writing, within thirty (30) days from the date of this notice, that the above personally identifiable information is not to be designated as directory information with respect to that student for the ensuing school year.

Uinta County School District Number One does not discriminate on the basis of race, color, religion, national origin, sex, age, disability, genetic information, sexual orientation, gender identity, status as a parent, marital status, or political affiliation in admission or access to, or treatment or employment in its educational programs or activities. NOTIFICATION OF RIGHTS UNDER FERPA FOR ELEMENTARY AND SECONDARY SCHOOLS

The Family Education Rights and Privacy Act (FERPA) affords parents and students over 18 year of age (“eligible students”) certain rights with respect to the student’s education records.  These rights are:

The right to inspect and review the student’s education records within 45 days of the day the School receives a request for access.

            Parents or eligible students should submit to the school principal (or appropriate school official) a written request that identifies the record(s) they wish to inspect.  The School official will make arrangement for access and notify the parent or eligible student of the time and place where the records may be inspected.

The right to request the amendment of the student’s education records that the parent or eligible student believes are inaccurate.

            Parents or eligible students may ask the school to amend a record that they believe is inaccurate.  They should write the School principal (or appropriate school official), clearly identify the part of the record they want changed, and specify why it is inaccurate.  If the School decides not to amend the record as requested by the parent or eligible student, the School will notify the parent or eligible student of the decision and advise them of their right to a hearing regarding the request for amendment.  Additional information regarding the hearing procedures will be provided to the parent or eligible student when notified of the right to a hearing.

The right to consent to disclosures of personally identifiable information contained in the student’s education records, except to the extent that FERPA authorizes disclosure without consent.

            One exception, which permits disclosure without consent, is disclosure to school officials with legitimate educational interest.  A school official is a person employed by the School as an administrator, supervisor, instructor, or support staff member (including health or medical staff and law enforcement unit personnel); a person serving on the School Board; a person or company with whom the School has contracted to perform a special task (such as an attorney, auditor, medical consultant or therapist); or a parent or student serving on an official committee, such as a disciplinary or grievance committee, or assisting another school official in performing his or her tasks.

            A school official has a legitimate educational interest if the official needs to review an education record in order to fulfill his or her professional responsibility.  Also, upon request, the School discloses education record without consent to officials of another school district in which a student seeks or intends to enroll.

The right to file a complaint with the U.S. Department of Education concerning alleged failures by the School District to comply with the requirements of FERPA. The name and address of the Office that administers FERPA are:

The Uinta County Commissioners met in regular session on July 18, 2023 in the commission chambers, 225 9th Street, Evanston. Chairman Mark Anderson convened meeting at 2:00 p.m. Commissioner Brent Hatch and Commissioner Eric South were present.   Also present:  Amanda Hutchinson, County Clerk; and Terry Brimhall, Treasurer.

Agenda

Motion South, second Hatch to approve the agenda amended to include Amanda Hutchinson with a mosquito contract, Gary Welling with a quote for fiber to the Sheriff’s Office, Loretta Kallas presenting for Gus Bloomfield, Andy Kopp presenting for Brian Anson, and SaraLee Gross with a CMAQ contract.  3 yes votes, passed.

Board Appointments

Motion Hatch, second South to accept Chairman Anderson’s resignation from the Bridger Valley Water Joint Powers Board and to appoint Barney Brisko to his unexpired term.  3 yes votes, passed. 

WYDOT Construction Permit

Motion Hatch, second South to approve a Construction Permit with WYDOT for $250.00 granting access to Lot 1, Block 1 of the YAHA Subdivision for construction purposes.  3 yes votes, passed.

Juvenile Services Board Grant Amendment

Motion South, second Hatch to approve a grant amendment with Department of Family Services delineating the requirements of the grant pertaining to Youth Services provided by the County as requested by Loretta Kallas, County Attorney.  3 yes votes, passed.

Mosquito Management Grant

Motion Hatch, second South to approve a grant with the Wyoming Dept. of Agriculture for $60,000.00 for mosquito abatement with a County match of $60,000.00 as requested by Amanda Hutchinson, County Clerk.  3 yes votes, passed.

Letter of Intent

Motion Hatch, second South allowing Chairman Anderson to sign a Letter of Intent authorizing UMR to release the County’s health plan claim data to Pareto Health for stop loss reimbursements as requested by Hutchinson.   3 yes votes, passed.

Alcohol Sales Extended Hours

Motion Hatch, second South to approve extended hours for alcohol sales on Labor Day weekend, Sept. 1, 2, and 3 as requested by Kim Goble, Chief Deputy County Clerk.  3 yes votes, passed.

Motorola Service Agreement

Motion South, second Hatch to approve a service agreement with Motorola Solutions to provide technical support for the radio towers for $1,799.42 annually as requested by Andy Kopp, Sheriff.  3 yes votes, passed.

All West Quote

Motion Hatch, second South to approve a quote from All West to run fiber from their service yard to the Uinta County Detention Center to improve internet and 911 performance for $42,515.54 with $1,040 in monthly fees as requested by Gary Welling, Dept. Head.  3 yes votes, passed.

CMAQ Resolution

Motion South, second Hatch to approve Resolution 23-26 authorizing submission of an application with WYDOT for dust suppression on County Roads as requested by Saralee Gross, Road and Bridge.  3 yes votes, passed.

Motion Hatch, second South to approve the Certification of Title VI stating that Uinta County will follow the non-discrimination guidelines when accepting bids for the CMAQ grant as requested by Saralee Gross, Road and Bridge.  3 yes votes, passed.
