NOTICE OF PUBLIC HEARING

Please be informed that on Monday, July 1st at 6 p.m. in the Council Chambers at City Hall, 1200 Main Street, Evanston, WY, the City Planning and Zoning Commission/Board of Adjustment will conduct a public meeting to consider the following public hearing requests pursuant to Article 2, Chapter 24, Zoning of the 1982 Code of the City of Evanston, WY.

CP 224 A request by Marty Anderson for a Conditional Use Permit to allow a two-family attached dwelling on property located at 261 Tomahawk Drive, Evanston, Wyoming, which is zoned Low Density Residential-Developing (LR-D).  If approved, the applicant will subdivide the lot into two lots, thereby placing each dwelling on its own lot.  (Section 24-15 A. (2)) 

BA 225 A request by Marty Anderson for a Variance to allow a principal building to encroach approximately 8.5 feet into the minimum 20-foot rear yard setback and to allow up to a 55 percent reduction of the minimum 5,000-square foot usable open space per dwelling unit requirement for property located at 261 Tomahawk Drive, Evanston, Wyoming, which is zoned Low Density Residential-Developing (LR-D).  (Section 24-16 D. June 4, 2024

The Uinta County Commissioners met in regular session on June 4, 2024 in the commission chambers, 225 9th Street, Evanston. Chairman Mark Anderson convened meeting at 2:00 p.m. Commissioner Brent Hatch and Commissioner Eric South were present. Also present:  Amanda Hutchinson, County Clerk.

Agenda

Motion South, second Hatch to approve the agenda amended to include the Commissioners with a resolution, and Kim Martin and Wayne Unruh with road concerns.  3 yes votes, passed.

Road Concerns

Kim Martin and Wayne Unruh voiced their concerns about County Road conditions.  The Commissioners explained the road repairs have been delayed due to a staffing shortage and the late spring season but noted that Road and Bridge now has begun the process of blading and repairing the roads.

Prevention Grant

Motion Hatch, second South to approve a grant agreement between the Wyoming Dept. of Health and Uinta County for $313,451 to provide funding for activities to prevent substance, alcohol and tobacco use, misuse, or abuse through June 30, 2026 as presented by Kendra Safford, Prevention Specialist.  3 yes votes, passed.

Manderfeld Subdivision

Kent Williams, Planner, opened a public hearing to allow for comments on the Manderfeld Subdivision located in the SE1/4 SW1/4 and the SW1/4 SE1/4 Section 24, T15N R121W.  Fred Coles, Wasatch Surveying; Brian Manderfeld, and Patrick Montgomery spoke in favor; no one spoke in opposition.  Motion South, second Hatch to approve Resolution 24-14 authorizing a map amendment from Agricultural/Resource/Development Land to Residential. 3 yes votes, passed.  Motion Hatch, second South to approve Resolution 24-15 authorizing the Manderfeld Subdivision.  3 yes votes, passed.

First Regular Meeting

June 4th, 2024

The official record of proceedings of the first regular meeting of the Evanston City Council for the month of June was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live.

Council member Perkes led those in attendance in the Pledge of Allegiance to the Flag.

The roll was called and with a quorum being present, Mayor Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Tim Lynch, Jesse Lind, Evan Perkes, Dave Welling, Mike Sellers and Jen Hegeman.

Street Closure Permit requested by Eli & Brandy Robinson for a neighborhood 4th of July Block Party on Thursday, July 4, 2024 on Sage Street between 4th Street and 5th Street, from 3:00 pm to midnight.

Council member Perkes recused himself. The motion passed unanimously with 6 yes votes: Williams, Lynch, Lind, Welling, Sellers, Hegeman.

Ordinance 24-03

Council member Lind moved, Council member Welling seconded, to pass Ordinance 24-03 on third and final reading.

AN ORDINANCE APPROVING AND AUTHORIZING THE FINAL PLAT FOR THE GATEWAY ADDITION, LOCATED IN THE CITY OF EVANSTON, WYOMING, BEING MORE PARTICULARLY DESCRIBED HEREIN.

WHEREAS, the subdividers, Wyoming Horse Racing LLC and Porter's Property Holdings LLC, Wyoming limited liability companies, have made application to the governing body of the City of Evanston, Wyoming for approval and authorization of the proposed subdivision entitled the Gateway Addition, located within the City of Evanston, Wyoming; and

WHEREAS, the City of Evanston finds that all of the requirements of Section 22, "Subdivision Regulations" of the Code of the City of Evanston, have been complied with, including notice of hearings and hearings thereof;

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, THAT:

Section 1.  The final plat of the Gateway Addition is hereby approved, accepted and authorized and described in particularity as follows, to-wit:

The "Gateway Addition" is a subdivision of part of the S ½ SE ¼ of Section 19, T15N, R120W, 6TH P.M., and Lot 3, Block 1 of the West Interchange Addition, located in the City of Evanston, Uinta County, Wyoming, said "Gateway Addition" being more particularly described as follows:

BEGINNING at a point on the South line of said Section 19, said point of beginning lying S 89°46'27" W, 541.25 feet from the Southeast corner thereof, said point of beginning also being the Southeast corner of said Lot 3;

thence S 89°46'27" W, 1262.23 feet along the South line of said Lot 3 and said South line of Section 19 to the Southerly right-of-way line of Prospector Drive;

thence N 58°05'27" E, 306.31 feet along said Southerly right-of-way line;

thence N 71°30'04" E, 1055.16 feet along said Southerly right-of-way line and the North line of said Lot 3 to the Northeast corner thereof;

thence S 0°10'52" E, 491.73 feet along the East line thereof to the POINT OF BEGINNING.

Said "Gateway Addition" containing 7.985 acres, more or less.

Section 2.  The Mayor and City Clerk of the City of Evanston are hereby authorized and directed to enforce the mandates of Chapter 22 of the Code of the City of Evanston, referring to the payment of necessary fees and land dedication requirements by the subdivider and the filing of the final plat with the County Clerk of Uinta County, Wyoming as by law required.

AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 7-112 B., AND 7-113, THE CODE OF THE CITY OF EVANSTON, WYOMING RELATING TO STORM WATER RUNOFF PLAN REVIEW AND DRAINAGE FEES OF THE CITY OF EVANSTON, WYOMING STORM WATER RUNOFF CONTROL ORDINANCE, PROVIDING FOR SETTING OF STORM WATER PLAN REVIEW AND DRAINAGE FEES BY RESOLUTION ADOPTED BY THE EVANSTON CITY COUNCIL.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules, the Commission hereby gives notice of the Application of Rocky Mountain Power (RMP or the Company) for a Certificate of Public Convenience and Necessity (CPCN) to construct a new substation adjacent to the existing Deer Creek substation and approximately 100 yards of transmission line southwest of Glenrock, Wyoming (the Project), as more fully described below:

  1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming under certificates of public convenience and necessity issued by the Commission. RMP is a public utility and subject to the Commission’s jurisdiction. Wyo. Stat. §§37-1-101(a)(vi)(C) and 37-2-112.
  2. On May 14, 2024, the Company filed an Application together with supporting exhibits requesting a CPCN to: [i] construct a new two feeder 69/13.2-kV substation; [ii] construct approximately 100 yards of new transmission lines; [iii] upgrade two supporting poles for transmission lines; and [iv] to install or construct other upgrades, as necessary, to existing switchgear and control equipment.
  3. RMP states the existing Deer Creek substation is at the end of its design life and its replacement is necessary to provide reliable electric service to customers in Glenrock, Wyoming. The Project will be located 800 feet southeast of the I-25 East entrance ramp from Deer Creek Road in Converse County, 2 miles southwest of Glenrock, and approximately 800 meters west of the existing substation. The Project will be entirely on state property and no new rights-of-way are required.
  4. RMP further states the Project will allow the Company to provide cost effective reliable service and the ability to support increasing demand in the town of Glenrock. The Company estimates construction of the Project to begin on or around December 1, 2024, with an estimated completion date in September 2025. The estimated total cost for the Project is approximately $9.2 million. The Company intends to finance the Project through its normal internal and external sources of capital. The Company has not requested any rate change or ratemaking treatment in the context of this Application.
