FORECLOSURE SALE NOTICE

WHEREAS, default in the payment of principal and interest has occurred under the terms of a Promissory Note (the “Note”) dated June 12, 2020, executed and delivered by Eric D. Davidson (“Mortgagor”) to First Bank of Wyoming, A Division of Glacier Bank, and a real estate Mortgage (the “Mortgage”) of the same date securing the Note, which Mortgage was executed and delivered by Eric D. Davidson and Monyka L. Davidson, to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for First Bank of Wyoming, A Division of Glacier Bank, its successors and assigns as Mortgagee, and which Mortgage was recorded on June 12, 2020, at Reception No. 1087358, in Book 1096, at Page 59-79 in the public records in the office of the County Clerk and ex-officio Register of Deeds in and for Uinta County, State of Wyoming; and

WHEREAS, the Mortgage was assigned for value as follows:

All in the records of the County Clerk and ex-officio Register of Deeds in and for Uinta County, Wyoming.

WHEREAS, the Mortgage contains a power of sale which by reason of said default, the Mortgagee declares to have become operative, and no suit or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part thereof, nor has any such suit or proceeding been instituted and the same discontinued; and

WHEREAS, written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and the party in possession of the mortgaged premises at least ten (10) days prior to the commencement of this publication, and the amount due upon the Mortgage as of August 18, 2022 being the total sum of $188,810.45, plus interest, costs expended, late charges, and attorneys’ fees accruing thereafter through the date of sale;

WHEREAS, the property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale. Any prospective purchaser should research the status of title before submitting a bid;

WHEREAS, if the foreclosure sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of his/her/its money paid.  The Purchaser shall have no further recourse against the Mortgagee, Mortgagor, Servicer or their attorneys;

NOW, THEREFORE The Money Source Inc., as the Mortgagee, will have the Mortgage foreclosed as by law provided by causing the mortgaged property to be sold at public venue by the Sheriff or Deputy Sheriff in and for Uinta County, Wyoming to the highest bidder for cash at 10:00 o’clock in the forenoon on September 14, 2022 at the information desk at the Uinta County Courthouse located at 225 9th Street, Evanston, WY 82930, for application on the above described amounts secured by the Mortgage, said mortgaged property being described as follows, to-wit:

With an address of 114 E Blackner St, Lyman, WY 82937 (the undersigned disclaims liability for any error in the address).

Together with all improvements thereon situate and all fixtures and appurtenances thereto.

Mortgagee shall have the exclusive right to rescind the foreclosure sale during the redemption period.  In the event that the sale is rescinded or vacated for any reason, the successful purchaser shall only be entitled to a refund of their purchase price and/or statutory interest rate.

NOTICE OF PUBLIC HEARING

TO CONSIDER TRADE OF REAL PROPERTY

Pursuant to Wyoming Statute 15-1-112, the governing body of the City of Evanston will conduct a public hearing for the purpose of receiving public information, input and objections regarding the proposed trade of the real property identified as “Parcel A”, which is  owned by the City for the real property identified as “Parcel B” which is owned by the Uinta County School District #1.  The public hearing shall take place at 5:30 p.m. on September 6, 2022, in the City Council Chambers, 1200 Main Street, Evanston, Wyoming. 

PARCEL A

A parcel of land located in the NW1/4 SW1/4 of Section 21, Township 15 North, Range 120 West, 6th P.M., City of Evanston, Uinta County, Wyoming, being more particularly described as follows:

Commencing at the Northwest corner of said Section 29 and running thence S 89°49’51” E, 2279.13 feet along the North boundary thereof: thence S 0°10’09” W, 1208.09 feet to the Northernmost corner of that parcel of land described by Quitclaim Deed in Book 2002 on Page 7 of the Uinta County Records  (U.C.S.D. No. 1 Parcel) and the POINT OF BEGINNING, said point lying on a curve to the right having a radius of 606.84 feet and from which corner the radial line bears S 14°28’44” W;

thence southeasterly 124.63 feet along the arc of said curve and the Northeasterly boundary of said U.C.S.D. No. 1 Parcel through a central angle of 11°46’02”, the long chord of which bears S 69°38’15” E, 124.41 feet, to a corner thereof, said corner being the point of compound curve of a curve to the right having a radius of 1336.79 feet and from which point the radial line bears S 26°14’47” W;

Notice is hereby given that Trout Unlimited is announcing that solicitation for qualifications and bid information is available for the furnishing of the:

Dry Fork Smiths Fork Road Realignment and Stream Restoration Project

The project site is in Wyoming about 26 miles north from Cokeville, Wyoming. This bid proposal will be for construction along the Dry Fork Smiths Fork on the High Desert District of the Bureau of Land Management. Activities will include construction of about 500 linear feet of new gravel-surfaced road and the reclamation of a similar length road segment, installation of a stream crossing culvert, and about 520 feet of stream habitat restoration. Construction work is planned to occur between July 15 and October 1, 2023.

Notice is hereby provided that any contractor wishing to act as general contractor on the project contact Jim DeRito to receive “solicitation to bid” information. There will be a mandatory pre-bidder meeting at the site on the 18th of August 2022.  Bids will be due the 25th of August at 5pm, unless modified at the mandatory site meeting.

This is not a Request for Proposal. Trout Unlimited is not obligated by this announcement to award any contract.
