NOTICE OF ACCEPTANCE OF AND FINAL SETTLEMENT

To all persons, firms, or corporations who have any claim for any work done for, or any material furnished to Staker & Parson Companies for the construction of 2024 Street Maintenance Project located in Evanston, WY you are hereby notified that the City of Evanston, Wyoming has accepted as completed, according to the plans and specifications and rules set forth in the contract between the City of Evanston and the aforesaid contractor, the work in connection with the construction of the above, and that said contractor is entitled to final settlement therefore.

You are further notified that upon the 8th of October 2024, being at least 40 days after the first publication of this notice, the City of Evanston will pay the full amount due under said Contract; and in the event that your claim is not filed with the City Clerk of said City prior to said 8th day of October 2024, the same shall be waived.

This notice is given pursuant to Section 15-1-113 (h), Wyoming Statutes.

NOTICE SETTING PUBLIC HEARING

  1. Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given that a public hearing is scheduled regarding Rocky Mountain Power’s (RMP or the Company) request for authority to establish Final Low-Carbon Energy Portfolio Standards. The public hearing is set to commence on Thursday, September 19, 2024, at 9:00 a.m., in the Commission’s hearing room located at 2515 Warren Avenue, Suite 300, in Cheyenne, Wyoming.
  2. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility, subject to the Commission's jurisdiction. WYO. STAT. §§ 37-l-101(a)(vi)(C) and 37-2-112.
  3. On March 29, 2024, RMP filed its Application requesting the Commission authorize the Company to establish its proposed Final Low-Carbon Energy Portfolio Standards.
  4. Wyoming Industrial Energy Consumers (WIEC), Powder River Basin Resource Council (PRBRC), and Jupiter Oxygen Corporation (JOC) petitioned to intervene in this matter, which the Commission granted by Order issued on April 30, May 14, and June 6, 2024. Office of Consumer Advocate is also a party under the provisions of Wyoming Statute §37-2-402(a).

Second Regular Meeting

August 20th, 2024

The official record of proceedings of the second regular meeting of the Evanston City Council for the month of August was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded.

Council member Welling led those in attendance in the Pledge of Allegiance to the Flag.

The roll was called and with a quorum being present, Mayor Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Tim Lynch, Jesse Lind, Evan Perkes, Dave Welling, Mike Sellers and Jen Hegeman.

Ordinance 24-06

Council member Sellers moved, Council member Perkes seconded, to pass Ordinance 24-06 on third and final reading.

AN ORDINANCE APPROVING AND AUTHORIZING THE FINAL PLAT FOR THE RIDGECREST 6TH ADDITION, LOCATED IN THE CITY OF EVANSTON, WYOMING, BEING MORE PARTICULARLY DESCRIBED HEREIN.

WHEREAS, the subdivider, Yellow Creek Ranch Co., Inc., has made application to the governing body of the City of Evanston, Wyoming for approval and authorization of the proposed subdivision entitled the Ridgecrest 6th Addition, located within the City of Evanston, Wyoming; and

WHEREAS, the City of Evanston finds that all of the requirements of Chapter 22, "Subdivision Regulations" of the Code of the City of Evanston, have been complied with, including notice of hearings and hearings thereof;

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, THAT:

thence S 16°19'15" E, 116.84 feet;

thence S 12°11'10" W, 147.98 feet;

thence S 63°21'33" W, 208.09 feet to a point on said Southeasterly boundary of Twin Ridge Subdivision No. 1;

thence N13°08'39" W, 38.09 feet along said Southeasterly boundary;

thence N 27°58'39" W, 190.00 feet  along said Southeasterly boundary to a corner thereof; thence N 62°46'21" E, 317.36 feet along said boundary to the POINT OF BEGINNING.

Motion Hatch, second South to approve a letter to the Industrial Siting Commission supporting a permit amendment for Uinta Wind Energy.  3 yes votes, passed.

Bridger Valley Transfer Station

Motion South, second Hatch to approve an application with the Dept. of Environmental Quality (DEQ) for a Chapter 6 Lifetime Operating Permit at the Bridger Valley Transfer Station as requested by Jeff Breininger, Maintenance.  3 yes votes, passed.

Commercial Enterprises & Holdings LLC Map Amendment

Kent Williams, Planner, opened a public hearing to allow for comments on Commercial Enterprises & Holdings LLC Map Amendment.  Justin Bradshaw spoke in favor, nobody spoke in opposition.  Motion South second Hatch to approve Resolution 24-31 authorizing a map amendment to change two parcels of land located in the S1/2 SE1/2 of Section 18, T16N, R114W from ARD to Commercial.  3 yes votes, passed. 

BV Estates Subdivision

Motion South, second Hatch to table the BV Estates Subdivision pending further information as requested by Williams.  3 yes votes, passed.

GT Nix Construction CUP

Williams opened a public hearing to allow for comments regarding a CUP (Conditional Use Permit) for GT Nix Construction for operation of a gravel pit and crusher in an Agricultural/Resource/Development Land Use District within one-half mile of a Residential Land Use District.  More specifically, certain portions of Sections 29, 31, 32 T15N, R115W.  Jace Nix, VP GT Nix Construction, spoke in favor; Larry Vercimak raised concerns regarding traffic and safety.  Motion South, second Hatch to authorize CUP 24-03 for GT Nix Construction to operate a gravel pit and crusher in an A/R/D Land Use District within one half mile of a residential land use district.  3 yes votes, passed.

Motion Hatch second, South to approve the following requested mill levies as requested by Lori Perkins, Assessor: School District One – 46.5, School District Four – 44.7, School District Six – 45.7, Evanston, Bear River, Lyman and Mountain View – 8.0 each, County – 11, Library – 1, Conservation – .463, Fire District – 3, Weed & Pest – 1, Bridger Valley Water Conservation – 1.0, Ft Bridger Cemetery – 2.0, and Fort Bridger Water & Sewer – 8.0.  3 yes votes, passed.

The City of Evanston (Owner) is requesting Bids for the construction of the Grass Valley Lift Station Project.

Bids for the construction of the Project will be received at 1200 Main Street, Evanston, Wyoming, 82930, until September 12, 2024 at 1:00 pm local time. At that time the Bids received will be publicly opened and read.

The Project includes the following work:

Owner anticipates that the Project’s total bid price will be approximately $315,000.00. The Project is expected to be substantially complete by November 1, 2025.
