Notice is hereby given that the Uinta County School District #1, has issued a certificate of substantial completion to Lewis & Lewis. for the work performed on the Waterline and Paving project, at the Evanston High School in Uinta County, Wyoming. The Department has accepted the work as substantially complete according to the contract and associated documents and therefore the contractor is entitled to payment of the full amount due under the contract, which will occur on August 12, 2024.

The Uinta County Commissioners met in regular session on August 6, 2024 in the commission chambers, 225 9th Street, Evanston. Chairman Mark Anderson convened meeting at 2:00 p.m. Commissioner Brent Hatch and Commissioner Eric South were present. Also present: Amanda Hutchinson, Clerk.

Agenda

Motion Hatch, second South to approve the agenda amended to include Aaron Hutchinson with a contract.  3 yes votes, passed.

FY25 Budget Resolution Amendment

Motion South, second Hatch to approve Resolution 24-28 correcting Resolution 24-24 to reflect a change in the grant fund.  3 yes votes, passed.

Bike Trail Closure

Motion Hatch, second South to approve closure of the Rio Oso Bike Trails during the Bear River Mountain Man Rendezvous August 22nd – 25th, 2024.  3 yes votes, passed.

Mosquito Management Grant

Motion South, second Hatch to approve a grant with the Wyoming Dept. of Agriculture for $45,000.00 for mosquito abatement with a County match provided by Weed and Pest in the amount of $45,000.00 as requested by Ron Taylor, Environmental Services.  3 yes votes, passed.

Landfill Borrow Investigation Proposal

Motion Hatch, second South to approve a bid from Trihydro for engineering services to investigate the viability of using existing soil stockpiles as clay soil liner material for the Evanston Landfill #2 closure for $14,601.00 as requested by Taylor.  3 yes votes, passed.

Mountain View Senior Center Parking Lot

Motion Hatch, second South to award the bid for replacement of the parking lot at the Mountain View Senior Center to Dave Norris Construction for $110,035.00 as requested by Jeff Breininger, Maintenance.  3 yes votes, passed. 

Transfer of Entitlements

Motion Hatch, second South to approve the transfer of $150,000 for fiscal year 2024 from Fort Bridger Airport Entitlements to Hunt Field as requested by Breininger.  3 yes votes, passed.

Senior Center Lease

Motion South, second Hatch to approve a Lease Agreement with the Uinta Senior Citizens, Inc. for the purpose of operating a senior citizens’ center and associated services in Mountain View for a monthly sum of $2,200.00 with a $2,000 in-kind monthly credit; and in Evanston for a monthly sum of $3,400.00 with an in-kind monthly credit of $3.000.00 provided against the monthly rent due as presented by Glenn Roach, Senior Center Director.  3 yes votes, passed.

Whittaker Estates Subdivision

Kent Williams, Planner, opened a public hearing to allow for comments on the Whittaker Estates Subdivision.  A Subdivision located in the W1/2 of Section 14, T15N, R116W.   Todd Whittaker spoke in favor; no one spoke in opposition.  Motion South, second Hatch to approve Resolution 24-29 authorizing the Whittaker Estates Subdivision.  3 yes votes, passed. 

WYHYFCU Subdivision

Kent Williams, Planner, opened a public hearing to allow for comments on the WYHYFCU Subdivision, a Re-Subdivision of Lot 1 Block 4 of the Rees Subdivision located in the NW ¼ of Section 1, T15N, R115W.  Dennis Covolo spoke in favor and had road access suggestions, Seth Harris, WHS Engineering & Surveying, responded that the access issue is being addressed; No one spoke in opposition.  Motion Hatch, second South to approve Resolution 24-30 authorizing the WYHYFCU Subdivision.  3 yes votes, passed. 

Malt Beverage Permit

Motion South, second Hatch to approve a 24-Hour Malt Beverage Permit for the Mountain View Lion’s Club from August 30th – September 2nd, 2024.  3 yes votes, passed.

Victim Witness Grant

Motion South, Second Hatch to approve the annual Victim Witness Contract with the Office of the Attorney General for a term of July 1, 2024 through June 30, 2025 for a maximum amount of $81,739.00 with a county match of $11,300.00 as requested by Gina Sundquist, Victim Witness Coordinator.  3 yes votes, passed.

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules and Regulations, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) requesting authority to increase its retail electric service rates by approximately $123.5 million per year, or an average overall increase of 14.7 percent with rates effective on and after June 1, 2025; establish an Insurance Cost Adjustment (ICA) rider; revise the Energy Cost Adjustment Mechanism (ECAM); implement a Wildfire Mitigation Plan (WMP); and implement a voluntary Renewable Energy Credit (REC) program, as more fully described below:

  1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming under certificates of public convenience and necessity issued by the Commission. RMP is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-l-101(a)(vi)(C) and 37-2-112.
  2. On August 2, 2024, RMP submitted an Application, together with supporting testimony, exhibits and revised tariff sheets, requesting the Commission approve the Company’s proposal to implement an increase in its Wyoming retail electric utility service rates of $123.5 million per annum, or an average overall increase of 14.7 percent; establish an ICA rider to recover excess liability insurance premium costs and support a future self-insurance mechanism; revise its ECAM to develop separate cost categories and implement a symmetrical sharing band of 85/15 for defined Category 1 costs and 95/5 for defined Category 2 costs; implement a WMP; and implement a voluntary REC program which permits the Company to retire Renewable Energy Credits on behalf of industrial customers. The Company requests this be effective for service rendered on and after June 1, 2025, with the exception of the proposed revisions to the ECAM, which the Company requests to become effective January 1, 2025.
  3. RMP requests a return on equity of 9.65 percent resulting in an overall cost of capital and return on rate base of 7.45 percent based upon a capital structure consisting of 50 percent debt, 50 percent equity, and a cost of debt of 5.25 percent. The Company states this reflects market circumstances for the twelve months beginning January 1, 2023, adjusted to a forecast test period of calendar year 2025.
  4. RMP states the requested rate increase is primarily driven by: (1) capital investments including the Gateway South and Gateway West Segment D-1 transmission lines, and the Rock Creek II Wind project; (2) operations and maintenance expense increases; and (3) insurance costs related to rising wildfire risk.
