First Regular Meeting
August 1st, 2023
The official record of proceedings of the first regular meeting of the Evanston City Council for the month of August was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded.
Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag.
The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.
Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Evan Perkes, David Welling, Mike Sellers and Jen Hegeman. Tim Lynch and Jesse Lind were excused.
Staff members present at the start of the meeting were: City Attorney/Prosecutor, Mark Harris; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Public Works Director, Gordon Robinson; Director of Parks and Recreation, Kim Larson; Director of Engineering and Planning, Dean Barker; Community Development Director, Rocco O’Neill and Police Lieutenant Ken Pearson. Information Technology Coordinator, Preston Sheets and Police Chief, Mike Vranish were excused. A group of interested citizens was also present.

Council Comments
Council member Sellers recognized the Uinta County Start Up Challenge provided by Impact 307 and what a wonderful job everyone did. He also stated that it will be good to get the Chip Seal done.
Council member Hegeman reminded everyone to support the businesses on Lincoln Highway. She commented that they will be struggling due to the cancellation of the Rodeo Series this summer. She also shared an inspiring story about a participant in the Tevis Cup competition.
Mayor Williams also mentioned what a great event the Uinta County Start Up Challenge was. He recognized and congratulated all the participants.

Department Comments
Parks & Rec Director, Kim Larson thanked Gordon and Public Work for helping with drain issues.
Public Works Director, Gordon Robinson congratulated Wastewater employee, Daniel Sowers for passing the Level IV Certification test. City Attorney, Mark Harris mentioned Municipal Court was functioning fully on Monday and Tuesday after the transition of the new Judge and City Attorney.

The Uinta County Commissioners met in regular session on August 1, 2023 in the commission chambers, 225 9th Street, Evanston. Chairman Mark Anderson convened meeting at 2:00 p.m. Commissioner Brent Hatch and Commissioner Eric South were present. Also present: Amanda Hutchinson, County Clerk and Loretta Kallas, County Attorney.

Motion South, second Hatch to approve the agenda amended to include Amanda Hutchinson with a Malt Beverage Permit; Lori Perkins with the 2023 Mil Levies; Ian Siegusmund with a closure request. 3 yes votes, passed.
Mill Levies

Bike Trail Closure
Motion South, Second Hatch to approve closure of the Rio Oso Bike Trails during the Bear River Mountain Man Rendezvous August 24th – 27th, 2023.
Storm Water Permits
Motion South second Hatch to ratify 3 Renewal Forms with the Department of Environmental Quality requesting discharge authorization for storm water permits at the Bridger Valley Landfill, Evanston #2 Landfill, and Road & Bridge West to comply with the Clean Water Act. 3 yes votes, passed.
Malt Beverage Permit
Motion South, second Hatch to approve a Malt Beverage Permit for the Mountain View Lions Club during the Fort Bridger Mountain Man Rendezvous on September 1st thru 4th as requested by Amanda Hutchinson, County Clerk. 3 yes votes, passed.
Hamilton and Manley Street Closure
Motion Hatch, second South to approve the request for closure of Manley and Hamilton Street during the Fort Bridger Rendezvous to local and foot traffic only as requested by Clayton Flint. Flint assured Fire Chief, Eric Quinney, that the concrete barricades would only block one lane, allowing access to emergency vehicles if needed. 3 yes votes, passed.
Brinton 3rd Subdivision
Kent Williams, Planner, opened a public hearing to allow for comments on the Brinton 3rd Subdivision located in the SE1/4 NE1/4 Section 29, T16N R114W. Eric Wall, Uinta Engineering spoke in favor; LaDell Brinton, an adjacent property owner, raised several concerns regarding: unanswered questions, unable to provide comments at the last Planning and Zoning Meeting, compliance with the land use plan, usage, and easements. David Brinton provided information on ditch maintenance. Wall provided details about the easements and their location. Motion South second Hatch to approve Resolution 23-26 authorizing the Brinton 3rd Subdivision including verbiage about utility and drainage easement on the plat. 3 yes votes, passed.
Motion South second Hatch to approve Resolution 23-27 authorizing a map amendment from Agricultural/Resource/Development Land to Residential. 3 yes votes, passed.
Goodwood Ranch Subdivision
Kent Williams, Planner, opened a public hearing to allow for comments on the Goodwood Ranch Subdivision, a two lot, Residential zoned subdivision of Lot 3 Block 2 of the Aspen Springs Development Plat A located in Section 25, T13N R117W. Eric Wall, Uinta Engineering, spoke in favor; Kevin Stickler, Kristy Bennion, Tina Peck, Steve Flint, Esther Farberg, Susan Parkinson, Bobbi Jo Flint, Craig Salmon, Marty Purdy, and Linda Purdy all spoke in opposition with concerns mainly focused on lot sizes being less than 5 acres, expired covenants, too many people without enough resources, a shop being in the easement, and several other concerns. Chairman Anderson stated that the county does not enforce covenants. Loretta Kallas, Attorney told the crowd the commissioners responsibility when approving subdivisions is to determine if they qualify based on state statutes and the county land use plan. Motion South, second Hatch to approve Resolution 23-28 authorizing the Goodwood Ranch Subdivision. 3 yes votes, passed.
Fort Bridger Airport
Motion South, second Hatch to amend the agenda to include the review of a contract for the Fort Bridger Airport as requested by Kallas. 3 yes votes, passed. Motion South, Second Hatch to approve a contract with the FAA for a flight inspection and to authorize Chairman Anderson to sign the agreement once its available as it has already been reviewed by Kallas. 3 yes votes, passed.
