FORECLOSURE SALE NOTICE

WHEREAS, default in the payment of principal and interest has occurred under the terms of a Promissory Note (the "Note") dated February 2, 2004, executed and delivered by John S. Salter (“Mortgagor”) to Option One Mortgage Corporation, a California Corporation, and a real estate Mortgage (the "Mortgage") of the same date securing the Note, which Mortgage was executed and delivered by said Mortgagor, to said Mortgagee, and which Mortgage was recorded on February 2, 2004, at Reception No. 118035, in Book 815, at Page 506 in the public records in the office of the County Clerk and ex-officio Register of Deeds in and for Uinta County, State of Wyoming; and

WHEREAS, the Mortgage was assigned for value as follows:

Assignee: HSBC Bank USA, National Association, as Trustee for ACE Securities Corp. Home Equity Loan Trust, Series 2004-OP1, Asset Backed Pass-Through Certificates

All in the records of the County Clerk and ex-officio Register of Deeds in and for Uinta County, Wyoming.

WHEREAS, the Mortgage contains a power of sale which by reason of said default, the Mortgagee declares to have become operative, and no suit or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part thereof, nor has any such suit or proceeding been instituted and the same discontinued; and

WHEREAS, written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and the party in possession of the mortgaged premises at least ten (10) days prior to the commencement of this publication, and the amount due upon the Mortgage as of February 28, 2024 being the total sum of $64,903.17, plus interest, costs expended, late charges, and attorneys' fees accruing thereafter through the date of sale;

WHEREAS, the property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale. Any prospective purchaser should research the status of title before submitting a bid;

WHEREAS, if the foreclosure sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of his/her/its money paid.  The Purchaser shall have no further recourse against the Mortgagee, Mortgagor, Servicer or their attorneys;

NOW, THEREFORE HSBC Bank USA, National Association, as Trustee for ACE Securities Corp. Home Equity Loan Trust, Series 2004-OP1, Asset Backed Pass-Through Certificates, as the Mortgagee, will have the Mortgage foreclosed as by law provided by causing the mortgaged property to be sold at public venue by the Sheriff or Deputy Sheriff in and for Uinta County, Wyoming to the highest bidder for cash at 10:00 o'clock in the forenoon on March 27, 2024 at the information desk at the Uinta County Courthouse located at 225 9th Street, Evanston, WY 82930, for application on the above described amounts secured by the Mortgage, said mortgaged property being described as follows, to-wit:

Part of Lots 6 and 7 in Block 23 of the Original Town of Evanston, Uinta County, Wyoming, filed August 10, 1870 on file in the Office of the Uinta County Clerk, bounded and described as follows:

COMMENCING at the Westerly corner of Lot 6, which is the intersection of the Southeasterly line of 11th Street and the Northeasterly line of Sage Street in said town and running thence in a Southeasterly direction and along the Northeasterly line of Sage Street, 70 feet to the intersection of said Northeasterly line of Sage Street and Line A as described in Book 63, Page 595, Uinta County, Wyoming records, thence at right angles in a Northeasterly direction and along said Line A, 80 feet, thence at right angle and in a Northwesterly direction and along a line parallel to said Northeasterly line of Sage Street, 70 feet to the Northwesterly line of said Lot:, thence at right angle and along said last mentioned line 80 feet to the PLACE OF BEGINNING.

The intention being to describe a tract of land fronting 70 feet on Sage Street and fronting 80 feet on 11th Street of said Town.

More Correctly Described As:

Part of Lots 6 and 7 in Block 23 of the Original Town of Evanston, Uinta County, Wyoming, filed August 19, 1870 on file in the Office of the Uinta County Clerk, bounded and described as follows:

COMMENCING at the Westerly corner of Lot 6, which is the intersection of the Southeasterly line of 11th Street and the Northeasterly line of Sage Street in said town and running thence in a Southeasterly direction and along the Northeasterly line of Sage Street, 70 feet to the intersection of said Northeasterly line of Sage Street and Line A as described in Book 63, Page 595, Uinta County, Wyoming records, thence at right angles in a Northeasterly direction and along said Line A, 80 feet, thence at right angle and in a Northwesterly direction and along a line parallel to said Northeasterly line of Sage Street, 70 feet to the Northwesterly line of said Lot:, thence at right angle and along said last mentioned line 80 feet to the PLACE OF BEGINNING.

The intention being to described a tract of land fronting 70 feet on Sage Street and fronting 80 feet on 11th Street of said Town. 

With an address of 1048 Sage Street, Evanston, WY 82930 (the undersigned disclaims liability for any error in the address).

Together with all improvements thereon situate and all fixtures and appurtenances thereto.

Mortgagee shall have the exclusive right to rescind the foreclosure sale during the redemption period.  In the event that the sale is rescinded or vacated for any reason, the successful purchaser shall only be entitled to a refund of their purchase price and/or statutory interest rate.

The Uinta County Commissioners met in regular session on February 20, 2024 in the commission chambers, 225 9th Street, Evanston. Chairman Mark Anderson convened meeting at 2:00 p.m. Commissioner Brent Hatch was present, Commissioner Eric South was excused. Also present:  Amanda Hutchinson, County Clerk, and Andy Kopp, Sheriff.

Agenda

Motion Hatch, second Anderson to approve the agenda amended to include Kim Goble with liquor license renewals, Amanda Hutchinson with a resolution, and Darby Noorda presenting for Gary Welling. 2 yes votes, passed.

Special Prosecution

Motion Hatch, second Anderson to approve Resolution 24-02 authorizing Clayton M. Melinkovich with the Sublette County Attorney’s Office to act as special prosecutor in Uinta County in a case with local conflict of interest as requested by Amanda Hutchinson, County Clerk on behalf of the County Attorney’s Office.  2 yes votes, passed.

Liquor License Renewals

Motion Anderson, second Hatch to approve the following Liquor License Renewals through April 2, 2025 as presented by Kim Goble, Chief Deputy County Clerk:  American Legion #36, Gold Buckle, Down Home Eatery, Fort Bridger Cash Store, Pete’s Rock N Rye Club, Travel Centers of America, The Green Onion Bar & Liquor Store, Uinta Lanes, and Wyoming Downs.  Extended hours for alcohol sales on July 4, August 31, September 1, and 2, 2024 was also approved.  2 yes votes, passed.

Support Letters

Motion Hatch, second Anderson to authorize the Commissioners to sign a letter in support of a grant application for Mountain View to create a Master Plan to help confront the challenges and opportunities that will result from the Terra Nuclear Power Plant, and the expansions of the Genesis Alkali Mine and the Exxon Gas Plant.  2 yes votes, passed.

Motion Anderson, second Hatch to authorize the Commissioner’s to sign a letter to the Wyoming State Shooting Complex Task Force in support of developing an International Shooting Complex on the property next to the Bear River State Park in Evanston.  2 yes votes, passed.

Contracts

Motion Hatch, second Anderson to award the bid to re-roof the Uinta County Extension Office to European Roofing for $27,000 as requested by Jeff Breininger, Maintenance.  2 yes votes, passed

Motion Hatch, second Anderson to award the bid to re-roof the Uinta County Courthouse upper roof to Broken Arrow for $143,309 as requested by Breininger.  2 yes votes, passed

Audio Eye Service

Motion Hatch, second Anderson to approve a quote from CivicPlus for Custom AudioEye which is a program to monitor ADA Compliance on the County’s website for $3,600 the first year, and $4,725 for the 2nd year as requested by Darby Noorda, Planning.  2 yes votes, passed.

Spackman Ranch CUP

Kent Williams, Planner, opened a public hearing to allow for comments regarding a CUP (Conditional Use Permit) for Spackman Ranch LLC to operate a Gravel Pit and Screen on property owned by the applicant in Section 9, T14N, R115W.  No one spoke in favor, No one spoke in opposition.  Motion Anderson, second Hatch to authorize CUP 24-01 pending the change of the renewal term to 1 year.  2 yes votes, passed.

Rendezvous Subdivision Plat A and Plat B

Kent Williams, Planner, opened a public hearing to allow for comments on the Rendezvous Subdivision Plat A for a parcel of land located in Part of Lot 1, Block 7, Part of Lots 3 and 4, Block 8 and Part of Vacated Manley Street, of the Carter’s Addition to Fort Bridger.  Located in the SE1/4 SW1/4 of Section 33 T16N, R115W.  Fred Coles, Wasatch Surveying, spoke in favor, no one spoke in opposition.  Motion Anderson, second Hatch to approve Resolution 24-03 authorizing a map amendment from Commercial to Residential, and to approve Resolution 24-04 authorizing the Rendezvous Subdivision Plat A.   2 yes votes, passed. 

Motion Hatch, second Anderson to approve Resolution 24-05 authorizing the Rendezvous Subdivision Plat B.  2 yes votes, passed.

INVITATION TO BID – (CRF2024)

The board of Uinta County Commissioners is accepting sealed bids for the price per ton for supplying and delivering of liquid Magnesium Chloride and the use of portable frac tanks (20,000 gallon min capacity) for dust suppression on Uinta County roads for the 2024 year.

Sealed bids will be accepted by Uinta County Clerk’s Office, PO Box 810, or 225 9th St Evanston, WY 82930 until 11:00 a.m. on March 13, 2024.  All eligible bids having been received prior to this date and time will be publicly opened and read at 11:00 a.m. on March 13, 2024. The envelope must be marked as “MAGNESIUM CHLORIDE SEALED BID (CRF2024)”. 

Bid documents can be picked up at the Uinta County Clerk’s office. Primary contact for this project is Saralee Gross, Uinta County Road & Bridge Administrative Assistant (307) 782-3254. Bid prices must be good for the 2024 construction season.  In reviewing the bids received, Uinta County reserves the right to reject, for any reason whatsoever, any and all bids, and to waive any informality or irregularity in a bid.  Uinta County will not be bound to accept the low bid, but rather the bid that is in the best interest of Uinta County.

Notice is hereby given that the Board of Uinta County Commissioners are requesting bids for the 2024 Dust Suppression Project consisting of the following items:

3,068 TONS OF MAGNESIUM CHOLRIDE FOR DUST SUPPRESSION

Successful contractor will be required to furnish all supervision, technical, personnel, labor, materials, machinery, tools, equipment, and services, including utility and transportation services to perform and complete all services and materials as defined in the bid documents.

Bid Documents are available from the Uinta County Clerk’s Office within the Uinta County Complex, 225 9th St. Evanston, Wyoming 82930

Sealed bids will be received at the Uinta County Clerk’s Office 225 9th St. Evanston, Wyoming until 11:00 a.m. local time, March 13, 2024.  Bids should be marked on the outside “Uinta County Dust Suppression Project CM23304” with the name and address of the bidder.  Primary contact for this project is Saralee Gross, Uinta County Road & Bridge Administrative Assistant (307) 782-3254.

Public opening of the bids will be on Wednesday, March 13, 2024 at 11:00 a.m. in the Uinta County Clerk’s Office, 225 9th St. Evanston, Wyoming.  Bidders are welcome to attend. This project is partially funded using Federal Grant Funds.  Therefore, all Federal Requirements associated with the use of these funds must be followed. 

All bids must be accompanied by either a certified check, cashier's check drawn on an acceptable bank, or an acceptable BID BOND, executed by an approved Surety Company, in an amount not less than five percent (5%) of the total sum of the bid.  The check or bond shall be made payable to Uinta County and shall be forfeited as liquidated damages if the bidder, upon the letting of the contract to him, fails to enter into the contract within thirty (30) days after it is presented to him for that purpose or fails to proceed with the performance of the contract in a timely manner.

All projects over $150,000.00 shall be bonded therefore the successful bidder shall provide a 100% performance and payment bond.  All projects over $7500.00 or less than $150,000.00 require a form of guarantee as approved by the county.

The Board of Uinta County Commissioners hereby notifies all bidders that minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, sex, creed, or national origin.

Uinta County reserves the right to accept or reject any items or all items, any part or all parts, any section or all sections, any bid or all bids as stated in the specifications to waive any irregularities or informalities, or to re-bid or re-advertise for bids if it is determined to be necessary or desirable and reserve the right to let the bid in any manner it sees fit.

Uinta County will not be bound to accept the low bid, but rather the bid that is in the best interest of Uinta County.
