The Uinta County Commissioners met in regular session on May 5, 2020 in the commission chambers, 225 9th Street, Evanston, Wyoming and via an online Zoom Meeting.  Chairman Eric South convened meeting at 2:00 p.m. Commissioner Craig Welling and Commissioner Mark Anderson were present.  Also present: Amanda Hutchinson, County Clerk.

Agenda

Motion Anderson, second Welling to approve the agenda amended to include a request from the Fair Office presented by Amanda Hutchinson and a request from Tom Kindler to speak to the Commissioners.  3 yes votes, passed.

Voting Districts

Motion Anderson second Welling to authorize Resolution 20-07 setting the Election Districts for the 2020 Election with no changes as requested by Amanda Hutchinson.  3 yes votes, passed.

Polling Places

Motion Welling second Anderson to establish the County Complex as an Absentee Polling Place as requested by Hutchinson.

WYDOT Acceptance Agreement

Motion Anderson, second Welling to approve an acceptance agreement with WYDOT work performed at the convergence of County Road 150 and Hwy 150 including vacating their right of way on County Road 150.  3 yes votes, passed.

Harmon Sub No. 2 Subdivision

Kent Williams, Planner, opened a public hearing to allow for comments on the Harmon Subdivision No.2 located in Block 2 Lot 8 of the Blacks Fork Estates Subdivision.  Eric Wall spoke in favor; no one spoke in opposition. Motion Welling second Anderson to approve Resolution 20-08 authorizing the Harmon Subdivision No. 2.  3 yes votes, passed.

CARES Act Airport Grant

Motion Anderson, second Welling to approve a grant for $30,000.00 for the Evanston-Uinta Airport Joint Powers Board as requested by Gary Welling.  3 yes votes, passed.

Citizen Request

Tom Kindler expressed frustration at an increase to his property taxes and with being charged for school taxes when the schools have been shut down.  He requested that things start opening back up.  Welling explained the role the Commissioners are playing in the process to of re-opening and explained the appeal process on property taxes.

UINTA COUNTY SCHOOL DISTRICT NUMBER ONE

NOTICE OF INTENT TO DESTROY SPECIAL EDUCATION RECORDS

The Special Services Department of Uinta County School District Number One will begin destroying special education records of students who have not received any special education services from the district in the last five years.  Destruction will begin on July 1, 2020.

All special education records of students who graduated from the district, reached the age of 21, moved from the district, dropped out of district schools, or gained inactive special education status five or more years before July 1, 2020 will be shredded beginning July 1, 2020.

Any parent/guardian or student who has reached the age of majority and is otherwise competent, may request a copy of the records in writing prior to June 30, 2020.

NOTICE OF INTENT TO AMEND RULES: 

CKA, AND ATTACHMENT CKA-R4, AUTHORIZING DISTRICT PERSONNEL TO CONCEAL CARRY A FIREARM ON DISTRICT PROPERTY PURSUANT TO W.S. §21-3-132

TO WHOM IT MAY CONCERN:

NOTICE IS HEREBY GIVEN that the Board of Trustees of Uinta County School District Number One (“The District”), State of Wyoming, in Evanston, Wyoming (“District”), intends to amend Rule CKA and the attachment CKA-R4, School Safety and Security Rule, Firearms:  Personnel Authorized to Carry, which were adopted by the District on April 17, 2019. Rule CKA and the attachments to CKA, allow employees to carry firearms on or in property or facilities owned or leased by Uinta County School District Number One, subject to the terms, conditions and limitations prescribed by state law, federal law, CKA, and the attachments to CKA.

The date of public notice is February 5, 2020.  The District has extended the comment period due to the COVID-19 pandemic until June 1, 2020.  The name and contact information of the contact person for Uinta County School District Number One is Ryan Thomas, 537 10th Street, PO Box 6002, Evanston, WY 82931, (307) 789-7571. This is also the contact information for the District.

CKA and the attachment, CKA-R4, are proposed as amendments to existing rules.  Rule CKA and the attachment, CKA-R4, are authorized by W.S. §21-3-132, Possession of Firearms on School Property - 2017 Session Laws, Chapter 209, “School Safety and Security,” Original House Bill No. 194.  The District has prepared a copy of the proposed amendments to the rules using the “strike and underline” method in which all proposed additions are underlined and strike-through items are proposed deletions.    

The District has prepared a statement setting forth the principal reasons for the adoption of the amendments to Rule CKA and the attachment, CKA-R4, containing the substance or terms of the proposed amendments to Rule CKA and the attachment, CKA-R4, and the basis and purpose of the proposed amendments to Rule CKA and the attachment, CKA-R4.

These amendments to Rule CKA and the attachment, CKA-R4, are not created to comply with federal law or regulatory requirements.  These amendments to Rule CKA and the attachment, CKA-R4 are created to more fully comply with W.S. §21-3-132.  The proposed amendments to the rule DO NOT exceed the minimum substantive state statutory requirements of W.S. §21-3-132. 

The District has evaluated the amendments to Rule CKA and the attachment, CKA-R4, in accordance with W.S. §9-5-304, and attached a copy of that evaluation to the copy of the proposed amended rules.  

A copy of the proposed amendments to Rule CKA and the attachment, CKA-R4,  the Board intends to adopt; a strike and underscore copy of the proposed amendments to Rule CKA and the attachment CKA-R4,  the Board intends to adopt; the statement setting forth the principal reasons for the adoption of Rule CKA and the attachment, CKA-R4; a copy of the evaluation of the proposed amendments to Rule CKA and the attachment, CKA-R4 in accordance with W.S. § 9-5-304; a copy of W.S. §21-3-132, a copy of W.S. §16-3-101 through §16-3-106, and all documents referenced herein may be obtained as follows:

Written submissions of data, views or arguments regarding this intended action shall be signed by the person who submits them, and must be received in the District Administrative Office no later than 4:00 p.m. on June 1, 2020, the final day of the comment period.

Interested persons may present data, views or arguments regarding this intended action orally at a public hearing to be held on May 19, 2020 at 6:00 p.m.  The hearing will be held via zoom and can be accessed at https://zoom.us/j/4897220541.

A public hearing will be held if requested by 25 persons, a government subdivision, or by an association having not less than 25 members. Requests for a public hearing may be submitted electronically to ckacomments@uinta1.com, or in writing to P.O. Box 6002, Evanston, Wyoming 82931.

Any person may urge Uinta County School District Number One not to adopt the amendments to Rule CKA and the attachment, CKA-R4, and request Uinta County School District Number One to state its reasons for overruling the consideration urged against adoption. Requests for an agency response must be made prior to, or within thirty (30) days, after adoption of the amendments to Rule CKA and the attachment, CKA-R4, electronically to ckacomments@uinta1.com, or in writing to P.O. Box 6002, Evanston, Wyoming 82931.

The Board of Trustees will consider all written and oral submissions with respect to the adoption of the proposed amendments to Rule CKA and the attachment, CKA-R4.

The Board intends to act to adopt these amendments to Rule CKA and the attachment, CKA-R4, at the first regularly scheduled Board meeting that takes place after the expiration of the comment period, the public hearing, and after the Board has considered all written and oral submissions with respect to the adoption of the proposed amendments to Rule CKA and the attachment, CKA-R4.

Notice is hereby given that UCSD #1 have issued a Request for Proposal (“RFP”) from firms/individuals for Professional Service Type in support of Evanston High School Fieldhouse Feasibility Study (“the Project”).
