Please be informed that on Monday, April 4th at 6 p.m. in the Council Chambers at City Hall, 1200 Main Street, Evanston, WY, the City Planning and Zoning Commission will conduct a public meeting to consider the following public hearing requests pursuant to Article 2, Chapter 24, Zoning of the 1982 Code of the City of Evanston, WY.

CP 132 A request by Tony Weaver for a Conditional Use Permit to allow a detached accessory building to exceed 60 percent of the square foot size of the principal building’s footprint located at 240 Darby Lane, Evanston, Wyoming, which is zoned Low Density Residential-Developing (LR-D).  The applicant is proposing to construct a detached accessory building measuring 40 feet by 70-feet (2,800 square feet).  (Section 24-26 C.)

Notice of Permit Approval

Broad Reach Power, LLC – Lincoln Solar 1 Energy Project

Before the Wyoming Industrial Siting Council

Notice of Permit Approval.  Pursuant to provisions in the Wyoming Industrial Development Information Act (W.S. 35-12-101 et seq.), notice is hereby given that the Lincoln Solar 1 Energy Project of Broad Reach Power, LLC (Applicant) has received a Permit to construct from the Wyoming Industrial Siting Council.  Records of the application and decision can be viewed during business hours in the offices of the Industrial Siting Division, Department of Environmental Quality.

The Permit will allow the Applicant to construct a solar energy facility to produce up to 80 megawatts of energy.  The project components include photo-voltaic panels, racking, wiring, inverter units, collector system, substation, metering and control house.  The project is located on 430 acres near the town of Cokeville, on private land in Lincoln County. 

Pursuant to W.S. 16-3-107, notice was given and the Wyoming Industrial Siting Council conducted a public hearing on the Application for Permit.  The hearing began at 8 A.M on January 26, 2022 at the Roundhouse, 1500 Main Street, Evanston, Wyoming.  The hearing concluded that afternoon of January 27, 2022 at the same location.  The Council considered the Applicant’s request pursuant to the provisions of the Industrial Development and Siting Act (W.S. 35-12-101 et seq.), and the Rules and Regulations adopted thereunder, and rendered a decision to grant the permit.

NOTICE OF SPECIAL MEETING

BOARD OF UINTA COUNTY COMMISSIONERS

Notice is hereby given that the Board of Uinta County Commissioners will hold a Special Meeting on Tuesday, March 22, 2022 at 9:00 a.m. to discuss options for truck parking during road closures with WYDOT, which may include several site visits.  No other business will be conducted during the Special Meeting.  The meeting will begin at the County Complex in Evanston.  All interested parties are invited to attend.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules, the Commission hereby gives notice of the Application of Rocky Mountain Power (RMP or the Company) for a Certificate of Public Convenience and Necessity (CPCN) to construct new wind turbines and update collector lines at the existing Rock River I Wind Energy Facility as more fully described below:

RMP is a public utility, as defined in Wyo. Stat. §37-1-101(a)(vi)(C), providing retail electric service under certificates of public convenience and necessity issued by the Commission. RMP is subject to the Commission’s jurisdiction pursuant to Wyo. Stat. §37-2-112.

On March 8, 2022, the Company filed an Application together with supporting testimony and exhibits requesting a CPCN to: [i] acquire generation plant assets; [ii] construct new wind turbines and associated infrastructure to replace the 50 previously installed wind turbines; [iii] update and install new 34.5 kilovolt (kV) collector lines as well as meteorological instrumentation and communication infrastructure; and [iv] make other upgrades, as necessary, to existing switchgear and control equipment as well as limited road realignments necessary for access to new turbine locations at the existing Rock River I project site (the Rock River Project). The Company’s Application included a Petition for Confidential Treatment and Protective Order.

The existing Rock River I facility is owned by Terra-Gen, LLC (Terra-Gen) and Shell Wind Energy Inc. (Shell). The Company has negotiated a Purchase and Sale Option Agreement (PSOA) with Terra-Gen and Shell to acquire all of its interests in the Rock River facility to allow the Company to repower the site if the Commission approves this Application. The Rock River Project will be adjacent to the Company’s High Plains/McFadden Ridge Wind Energy Project and will share its operation and maintenance facilities as well as certain site infrastructure. Once the Rock River Project is complete, 100 percent of the output from the Foote North Project will be used to serve the Company’s customers.

In its Application, RMP states that the Rock River I Project is a time limited opportunity that provide benefits to customers by qualifying the new wind turbines for federal production tax credits, which expire 10 years after a facility’s commercial operation date. To achieve these benefits, the Company estimates construction of the new turbines to be complete by October 2024. The estimated total cost for the Rock River I Project is approximately $93 million. RMP intends to finance the Rock River I Project through its normal internal and external sources of capital.

FORECLOSURE SALE NOTICE

WHEREAS, default in the payment of principal and interest has occurred under the terms of a promissory note (the “Note”) dated February 21, 2014, executed and delivered by Joseph A. Reichenberg to Wells Fargo Bank, N.A. and a real estate mortgage (the “Mortgage”) of the same date securing the Note, which Mortgage was executed and delivered by Joseph A. PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules and Special Regulations, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) for authority to revert the Blue Sky Block value to 100 kilowatt hours (kWh) from 200 kWh, as more fully described below.

RMP is a public utility as defined in Wyo. Stat. § 37-1-101(a)(vi)(C), subject to the jurisdiction of the Commission pursuant to Wyo. Stat. § 37-2-112.

On February 17, 2022, RMP submitted its Application requesting authority to revert the Company’s Renewable Energy Rider - Blue Sky Program value to 100 kWh from 200 kWh for tariff Schedules 70 and 72, effective May 1, 2022. The Company’s Blue Sky Program is offered to Wyoming customers through Schedule 70, Renewable Energy Rider Optional (Sheet Nos. 70-1 and 70-4), and Schedule 72, Renewable Energy Rider- Optional Bulk Purchase Program (Sheet Nos. 72-1 and 72-4). The Company seeks to revert the Block size to 100 kWh from 200 kWh due to the increasing price of Renewable Energy Credits (RECs).

Participation in the Blue Sky Program is optional for Wyoming customers who want to offset their energy usage requirements with renewable energy by purchasing blocks of bundled renewable energy certificates (RECs). Customers purchase RECs to ensure their energy consumption consists of renewable energy. The Company then retires those purchased RECs on the customer’s behalf and maintains Green-E certification of the Blue Sky Program. Currently, the Company’s tariff defines “Blocks” as 200 kWh of renewable energy. The Company requests the Block value revert to 100 kWh of renewable energy from 200 kWh in order to address market fluctuations. Customers will continue to have the right to purchase as many Blocks as they desire.

Schedule 70 provides customers with the opportunity to purchase Blocks at $1.95 per month. Schedule 72 provides a bulk purchase option for larger customers at $0.70 per month per Block, plus $1,500 per year fixed charge, customers must purchase a minimum of 1,212 Blocks per year.

According to RMP the forecast for 2022 indicates that if the block size remains at 200 kWh, the Blue Sky Program will have just enough funds to cover both REC purchases and administrative funds, but limited funds would be available for community renewable project grants. Conversely, if the block size reverts to 100 kWh, REC purchases will be halved.
