TAKE NOTICE that on the 5th day of July, 2023, the governing body of the City of Evanston, Uinta County, Wyoming, adopted a Resolution expressing its intent to annex a parcel of land located within the SE 1/4 NE 1/4 of Section 19, T15N, R120W, 6TH P.M., Uinta County, Wyoming. A location map showing the area to be annexed is set forth below. An Annexation Report has been prepared and is available for review at the City Clerk's office which in summary, indicates there are no infrastructure improvements needed within the existing boundaries of the City to accommodate the proposed annexation. Upon written request, the City Clerk will provide a legal description of the area to be annexed and the names of the person owning property within the area.

On August 15th, 2023, at 5:30 p.m., a public hearing will be held in the City Council Chambers of the Evanston City Hall, 1200 Main Street, Evanston, Wyoming, to receive comments from members of the public, to determine if the proposed annexation meets the conditions of W.S.

Legal Notice of Opportunity to Object

Anadarko Vegetation Management Project

The Uinta-Wasatch-Cache National Forest has completed the Environmental Assessment (EA) and the Draft Decision Notice and Finding of No Significant Impact (DN/FONSI) for the Anadarko Vegetation Management Project. The selected alternative in the draft DN would authorize the proposed action, which entails vegetation management using a combination of commercial timber harvesting, mechanical tree thinning, hand tree thinning, and prescribed fire to restore aspen ecosystems, increase vegetation age and structural diversity, restore riparian and upland meadow ecosystems, and reduce hazardous fuel loads on 68,298 acres on the Evanston-Mountain View Ranger District.

This action is subject to the predecisional administrative review process outlined in Title 36 of the Code of Federal Regulations (CFR), Part 218, Subparts A and B.  A final decision will not be made until after the requirements of 36 CFR 218.12, Timing of Project Decision, have been met. The Responsible Official is David Whittekiend, Forest Supervisor and the Objection Reviewing Officer is Mary Farnsworth, Regional Forester.

Eligibility to File Objections

Objections can be accepted only from individuals and entities who have submitted timely, specific written comments regarding a proposed project or activity subject to these regulations during any designated opportunity for public comment, per the regulations at 36 CFR 218.5(a). Additional eligibilities are established in 36 CFR 218.5(b) through (f). Issues raised in objections must be based on previously submitted timely, specific, written comments regarding the proposed project unless based on new information arising after designated opportunities for comment. A connection to previous comments must be demonstrated in the objection.

Individual members of organizations must have submitted their own comments to meet the requirements of eligibility as an individual. Objections received on behalf of an organization are considered as those of the organization only. If an objection is submitted on behalf of a number of individuals or organizations, each individual or organization listed must meet the eligibility requirement of having previously submitted comments on the project (36 CFR 218.7). Names and addresses of objectors will become part of the public record.

Contents of an Objection

Incorporation of documents by reference in the objection is permitted only as provided for at 36 CFR 218.8(b). Minimum content requirements of an objection as identified in 36 CFR 218.8(d) include:

Objector’s name and address with a telephone number if available; with signature or other verification of authorship supplied upon request;

Identification of the lead objector when multiple names are listed, along with verification upon request;

Name of project, name and title of the responsible official, national forest/ranger district where project is located, and

Sufficient narrative description of those aspects of the proposed project objected to, specific issues related to the project, how environmental law, regulation, or policy would be violated, and suggested remedies which would resolve the objection.

Statement demonstrating the connection between prior specific written comments on this project and the content of the objection unless the objection issue arose after the designated opportunities for comment.

Filing an Objection

Objections must be postmarked (if sent via postal mail), faxed, or submitted electronically via the project webpage at https://www.fs.usda.gov/project/uwcnf/?project=63728

within 45 days following publication of this legal notice. Mailed objections should be sent to Objection Reviewing Officer, USFS Intermountain Regional Office, 324 25th Street, Ogden, UT  84401. Objections may be faxed to 801-625-5365. Electronic objections must be submitted in a format such as an email message, pdf, plain text (.txt), rich text format (.rtf), or Word (.doc or .docx). Hand delivery of written objections can be made during normal working hours to the Intermountain Regional Office, Hansen Federal Building, Room 4016, 324 25th Street, Ogden, UT 84401. It is the responsibility of objectors to ensure their objection is received in a timely manner (36 CFR 218.9).

The publication date in the Salt Lake Tribune, the newspaper of record, is the exclusive means for calculating the time to file an objection to this project. Those wishing to object to the draft DN/FONSI should not rely upon dates or timeframe information provided by any other source.

The Uinta County Commissioners met in regular session on July 5, 2023 in the commission chambers, 225 9th Street, Evanston. Chairman Mark Anderson convened meeting at 2:00 p.m. Commissioner Brent Hatch and Commissioner Eric South were present.   Also present:  Amanda Hutchinson, County Clerk.

Motion Hatch, second South to approve the signing of a letter to Governor Gordon showing support to the State and requesting they make a 2nd attempt to purchase Union Pacific lands coming up for sale to ensure the lands are available for multiple uses as requested by Carl Larson.  3 yes votes, passed.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) for a Deferred Accounting Order to record a regulatory asset associated with incremental costs related to third-party liability for wildfires in Oregon, as more fully described below:

  1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-l-101(a)(vi)(C) and 37-2-112.
  2. On June 21, 2023, pursuant to Wyoming Statutes §§ 37-2-112 and 37-2-115, the Company filed an Application requesting the Commission issue a Deferred Accounting Order to record a regulatory asset associated with incremental costs related to third-party liability for wildfires in Oregon.
  3. RMP seeks authority from the Commission to record and defer, for possible future recovery, incremental costs associated with third party claims from the September 2020 Oregon wildfires. The costs identified, accounted, and tracked are the litigation costs that may exceed the Company’s allocated costs included in the approved rate tariff.
  4. RMP is not currently seeking recovery of these costs from customers. The requested Deferred Accounting Order, if approved, will enable the Company to seek recovery in the future. If approved, deferred costs will be recorded in Federal Energy Regulatory Commission (FERC) Account 182.3.
  5. The total amount of the potential deferral is unknown. Current liabilities are approximately $90 million. Deferred accounting will assist the Company in the ability to track and recover the continuing expenses resulting from the litigation.
  6. This is not a complete description of RMP’s Application.
