Uinta County man found guilty of sexual assault

EVANSTON — A Uinta County man was sentenced to serve four to eight years in prison after being convicted of first degree sexual assault of a minor. A jury found the man — whom we have chosen to identify only by his initials, B.U.W., to protect the identity of the victim — guilty of sexually assaulting his daughter in March of 2015.

Court documents show the assault was reported to Uinta County Sheriff’s deputies on March 1, 2015. The victim was then interviewed by Uinta County Sheriff’s Office Investigator Brooke Hale.

According to an affidavit filed in the case, the victim stated that her father, B.U.W., approached her on March 1, 2015, and presented her with a list of punishments for recent behavior. He then told her that the next thing would be hard for both of them and that she should think of it as punishment. 

The victim stated her father then proceeded to force her to engage in sexual acts, at one point threatening to hurt her if she attempted to hurt him. The victim reported the assaults to her mother, who did not live in the same residence as her father, that same day. 

The victim’s mother took her to Evanston Regional Hospital for evaluation, where an examination and sexual assault kit were completed. 

Evidence collected during the investigation was sent to the Wyoming State Crime Lab for processing. 

The man was charged with four counts of first degree sexual assault of a minor and declined to testify in his own defense. A jury found B.U.W. guilty on the first count and not guilty on the fourth count. The jury was unable to come to a verdict on counts two and three. A motion was filed by the man’s attorney to dismiss those counts with prejudice. The court granted the motion and B.U.W. will not be retried for those charges.

Uinta County Attorney Loretta Howieson stated, “These cases are really difficult for the victim. Since we already had a conviction we felt it was best to finalize the case.” 

In addition to the four- to eight-year sentence, B.U.W. was ordered to pay $150 to the Wyoming Victim’s Compensation Fund, $10 for court processing fees, $10 for indigent legal fees, $75 for a substance abuse assessment fee, and $3,180 toward the cost of his public defender. 

B.U.W. has filed an appeal with the Wyoming Supreme Court.
