NOTICE OF ACCEPTANCE OF

AND FINAL SETTLEMENT

To all persons, firms or corporations who have any claim for any work completed for, or any material furnished to SCI Inc., for the construction of the Union Center Power Conduit Project 2023 located in Evanston, Wyoming. You are hereby notified, that the City of Evanston, Wyoming has accepted as completed, according to the plans and specifications and rules set forth in the contract between the City of Evanston and the aforesaid contractor, the work in connection with the construction of the above, and that said contractor, is entitled to final settlement therefore.

You are further notified that upon the 27th of April 2023, being at least 40 days after the first publication of this notice, the City of Evanston will pay the full amount due under said contract; and in the event that your claim is not filed with the City Clerk of said City prior to said 27th day of April 2023, the same shall be waived.

This notice is given pursuant to Section 15-1-113 (h), Wyoming Statutes.

First Regular Meeting

March 7th, 2023

The official record of proceedings of the first regular meeting of the Evanston City Council for the month of March was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live.

Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag.

The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, Evan Perkes, David Welling, Mike Sellers and Jen Hegeman.  Jesse Lind was excused.

Staff members present at the start of the meeting were: City Attorney/Prosecutor, Amanda Kirby; Director of Engineering and Planning, Dean Barker; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Police Chief, Mike Vranish; Director of Parks and Recreation, Scott Ehlers; Information Technology Coordinator, Preston Sheets; Public Works Director, Gordon Robinson; and Senior Planner, DuWayne Jacobsen. Community Development Director, Rocco O’Neill was excused.  A group of interested citizens was also present.

Council Comments

Council member Welling recognized Public Works Director Gordon Robinson and his crew at Public Works for working so hard to keep the snow cleared.  He also wished the Cheer/Dance team good luck at State competitions.

All Council members agreed that everyone is tired of all the snow and are ready for spring.

Council member Sellers reminded everyone to be aware of people that may seem to be struggling, March and April tend to be bad months for people and if anyone needs help the U.S. National Suicide Prevention Lifeline is 988 or text “WYO” to 741-741 for the Crisis Text Line.

Council member Hegeman recognized International Women’s Day and all women celebrating.  She reminded everyone that Yellow Cup is giving away brownies in honor of the event.

ORDINANCE 23-01

Council member Sellers moved, Council member Welling seconded, to pass Ordinance 23-01 on third and final reading.

AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 15-37, PETIT

LARCENY, AND ADDING SECTION 15-37.1, THEFT OFSERVICES, TO THE CITY CODE TO AMEND THE TITLE AND MIRROR THE MONETARY LANGUAGE OF STATE STATUTE FOR THEFT OF SECTION 15-37 AND CODIFYTHE CRIMINAL ACT OF THEFT OF SERVICES INSECTION 15-37.1

WHEREAS, there is a need to amend Section 15-37 to the City Code to retitle it as “Theft” and mirror the monetary language of State Statute and to add 15-37.1 to the City Code to codify the criminal act of Theft of Services;

 NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT:

Section 1:        Section 15-37 of the Evanston City Code is amended and re-enacted to provide as follows:

  • 15-37. Theft

Whoever unlawfully steals, takes and carries, leads or drives away the property of another which has a value of one thousand dollars ($1000.00) or less is guilty of Theft.

Section 2:        Section 15-37.1 of the Evanston City Code is enacted to provide as follows:

  • 15-37.1. Theft of Services

A person who, with intent to defraud, obtains services which he knows are available only for compensation without paying for the services is guilty of Theft of Services if the value of the services is less than one thousand dollars ($1000.00).

Resolution 23-19

Council member Welling introduced Resolution 23-19.  Council member Welling moved, Council member Sellers seconded, to adopt Resolution 23-19.

RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF A CONTRACT FOR SERVICES WITH SECURAMAX AND PRO-VISION SOLUTIONS INC. TO PROVIDE SOFTWARE SERVICE AND HOSTING FOR LAW ENFORCEMENT PURPOSES.

Public Works Director, Gordon Robinson expressed appreciation for the recognition and gratitude the Mayor and Council gave to his staff for the great job they have done on snow removal.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules and Special Regulations, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) requesting authority to increase its retail electric service rates by approximately $140.2 million per year or an average overall increase of 21.6 percent with rates effective on and after January 1, 2024, and to revise the energy cost adjustment mechanism (ECAM) to eliminate the sharing band, as more fully described below:

  1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming under certificates of public convenience and necessity issued by the Commission. RMP is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-l-101(a)(vi)(C) and 37-2-112.
  2. On March 1, 2023, RMP submitted an Application, together with supporting testimony, exhibits and revised tariff sheets, requesting the Commission approve the Company’s proposal to implement an increase in its retail electric utility service rates in Wyoming of $140.2 million per annum or an average overall increase of 21.6 percent and to eliminate the existing 80/20 sharing band and recover 100 percent of prudently-incurred, Wyoming-allocated net power costs using the existing ECAM in tariff Schedule 95, effective on and after January 1, 2024.
  3. RMP is requesting a return on equity of 10.3 percent, and overall cost of capital and return on rate base of 7.60 percent and the equity component of the capital structure is 51.27 percent, which the Company states reflects market circumstances for twelve months beginning July 1, 2021, through June 30, 2022, adjusted to a forecast test period beginning January 1, 2024, through December 31, 2024, interest rates, operational risks and reasonable investor expectations as well as the returns generated by similarly situated or comparable utility companies.
  4. The Company states its requested rate increase is primarily driven by: (1) an increase in Net Power Costs (NPC) from $1.431 billion on a total-Company basis, or approximately $221.0 million on a Wyoming-allocated basis, authorized by the Commission in the RMP’s 2020 general rate case, to the proposed NPC of approximately $2.553 billion on a total-Company basis, or approximately $360.3 million on a Wyoming-allocated basis, which the Company states is largely driven by increased market prices for power and natural gas, increased contract prices for coal and coal supply limitations, and thermal generation operational changes due to federal and state environmental compliance requirements; and (2) continued capital investments, part of approximately $6.7 billion of new capital projects on a total-Company basis RMP expects to place into service between July 1, 2022 and December 31, 2024, including the Gateway South and Gateway West Segment D.1 transmission lines, the Rock Creek I wind project, the Foote Creek II-IV and Rock River I wind repowering projects, all of which include an associated rate of return of 7.60 percent and which the Company states are required for it to meet its obligation to serve its customers.

Notice is hereby given that the UINTA COUNTY WYOMING has accepted as completed according to the plans, specifications, and rules governing the same work performed under that certain Contract between Uinta County Wyoming and Wall Contractors, Rock Springs, Wyoming, the Contractor, on the County Road 274 Bridge Abutments.  The Contractor is entitled to final settlement for work under this Contract and the County will make final payment to the Contractor herein mentioned for the full amount due on the forty-first day after first publication of this notice (March 10, 2023).  Any claims should be submitted to the County.  Claims not filed with the County, prior to the forty-first day (April 20) after the first date of this publication, the same shall be waived.
