FORECLOSURE SALE NOTICE

WHEREAS, default in the payment of principal and interest has occurred under the terms of a promissory note (the “Note”) dated 03/21/2018 executed and delivered by Jonathan R Payne to Wells Fargo Bank, N.A. and a real estate mortgage (the “Mortgage”) of the same date securing the Note, which Mortgage was executed and delivered by Jonathan R Payne (the “Mortgagors”), to  Wells Fargo Bank, N.A., and which Mortgage was recorded on 03/23/2018, as Document No: 1050486, Book: 1065, Page: 103-120 in the records of the office of the County Clerk and ex-officio Register of Deeds in and for Uinta County, State of Wyoming; and

WHEREAS, the Mortgage contains a power of sale which by reason of said default, the Mortgagee declares to have become operative, and no suit or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part there-of, nor has any such suit or proceeding been instituted and the same discontinued; and

WHEREAS, written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and the party in possession of the mortgaged premises at least ten (10) days prior to the commencement of this publication, and the amount due upon the Mortgage on the date of first publication of this notice of sale being the total sum of $ 67,583.73 which sum consists of the unpaid principal balance of $62,327.54 plus Interest accrued to the date of the first publication of this notice in the amount of $4,126.28 plus attorneys’ fees, costs expended, and accruing interest and late charges after the date of first publication of this notice of sale;

WHEREAS, the property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale. Any prospective purchaser should research the status of title before submitting a bid;

The Uinta County Commissioners met in regular session on February 16, 2021 in the commission chambers, 225 9th Street, Evanston, Wyoming and via an online Zoom Meeting. Chairman Eric South convened meeting at 2:00 p.m. Commissioner Mark Anderson and Commissioner Brent Hatch were present.  Also present: Amanda Hutchinson, County Clerk.

Agenda

Motion Anderson, second Hatch to approve the agenda amended to include; Clay Baird with an additional item and remove the Hope Acres Phase 1 Subdivision topic.  3 yes votes, passed.

County Road 274 Bridge Permit

Motion Hatch, second Anderson to appoint Uinta Engineering as the contact with the Army Corps of Engineers for the County Road 274 Bridge project as requested by Barney Brisko, Road and Bridge Foreman.  2 yes votes, passed.

Gravel Crushing

Motion Hatch, second Anderson to appoint Forsgren and Associates as the engineering firm overseeing the gravel crushing project as requested by Brisko.  3 yes votes, passed.

Transfer of Entitlements

Motion Hatch, second Anderson to approve transfer of $150,000 for Fiscal Year 2020 and $150,000 for Fiscal Year 2021 from Fort Bridger Airport entitlements to Evanston-Uinta County Airport/Burns Field as requested by Clay Baird, Public Works Director.  3 yes votes, passed.

Fort Bridger Airport

Motion Anderson, second Hatch to approve a contract with Wyoming Dept. of Transportation setting forth the terms and conditions for the crack seal project at the Fort Bridger Airport for the term ending September 30, 2021 as presented by Baird.  3 yes votes, passed.

Landfill #1 Consultant

Motion Hatch, second Anderson to authorize the grant committee for the Evanston Landfill #1 Remediation Project to review the bids received for a professional services consultant and determine the recipient of the bid as requested by Baird.  3 yes votes, passed.

 Vaccination Funding MOU

Motion Hatch, second Anderson to approve a Memorandum of Understanding with the Wyoming Dept. of Health setting forth the terms and conditions by which the County shall utilize grant funds for COVID-19 vaccination campaign activities as requested by Kim Proffit, Public Health Nurse.  3 yes votes, passed.

Sick Leave Donation Resolution

Motion Anderson, second Hatch to approve Resolution 21-03 authorizing full-time employees to donate sick leave to part-time employees for COVID-19 Pandemic relief until the Governor of Wyoming declares the State of Wyoming to no longer be in a State of Emergency/Public Health Emergency due to COVID-19 as presented by Amanda Hutchinson, County Clerk. 3 yes votes, passed.

Kent Williams, Planner, opened a public hearing to allow for comments regarding a CUP (Conditional Use Permit) for Wyoming Hyperscale White Box to operate a Data Center in an ARD Land Use District located in section 4, T14N R118W.  Trenton Thornock and Brady Thornock spoke in favor; no one spoke in opposition.  Motion Hatch, second Anderson to authorize CUP 21-01 with Planning and Zoning conditions and requirements and a MOU outlining the maintenance and use of the County Road.  3 yes votes, passed.

H-MC Subdivision

Kent Williams, Planner, opened a public hearing to allow for comments on the H-MC Subdivision located in Section 21, T15N, R114W.  Eric Wall, Uinta Engineering, spoke in favor; no one spoke in opposition.  Motion Anderson, second Hatch to approve Resolution 21-04 authorizing the H-MC Subdivision.  3 yes votes, passed.

Second Regular Meeting

February 16th, 2021

The official record of proceedings of the second regular meeting of the Evanston City Council for the month of February was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded.  The meeting was also streamed live.

Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag.

The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, Evan Perkes, David Welling, Mike Sellers and Mikal Welling.  Tib Ottley was excused. 

Staff members present at the start of the meeting were:   City Attorney, Dennis Boal; City Treasurer, Trudy Lym;  Public Works Director, Gordon Robinson; City Clerk,  Diane Harris; Community  Development Director, Rocco O’Neill; Director of Parks and Recreation, Scott Ehlers; and Police Lieutenant, Ken Pearson.   Police Chief, Jon Kirby and City Engineer, Dean Barker were excused.  A group of interested citizens were also present.

            Council Comments

Council member Sellers thanked the Evanston Police Department for handling the recent incidents very well.  He expressed how grateful he is for the City’s Police Department.  Council member Sellers also reminded everyone to be aware of how people are acting as depression and suicide are on the rise due to being closed in. 

RESOLUTION 21-07

Council member Lynch introduced Resolution 21-07.  Council member Lynch moved, Council member Welling seconded, to adopt Resolution 21-07.

A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTI0N OF A SUB-AWARD AGREEMENT BETWEEN THE HIGHWAY SAFETY PROGRAM OF THE  WYOMING DEPARTMENT OF TRANSPORTATION AND THE EVANSTON POLICE DEPARTMENT TO RECEIVE GRANT FUNDS FOR IMPAIRED DRIVING ENFORCEMENT.                                                                                                                                                             

The motion passed unanimously with 6 yes votes:  Williams, Lynch, Perkes, Welling, Sellers, M. Welling.

RESOLUTION 21-08

Council member Sellers introduced Resolution 21-08.  Council member Sellers moved, Council member Perkes seconded, to adopt Resolution 21-08.

WHEREAS, the Mortgage contains a power of sale which by reason of said default, the Mortgagee declares to have become operative, and no suit or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part there-of, nor has any such suit or proceeding been instituted and the same discontinued; and

WHEREAS, written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and the party in possession of the mortgaged premises at least ten (10) days prior to the commencement of this publication, and the amount due upon the Mortgage on the date of first publication of this notice of sale being the total sum of $ 103,867.14 which sum consists of the unpaid principal balance of $99,216.56 plus Interest accrued to the date of the first publication of this notice in the amount of $2,507.77 plus attorneys’ fees, costs expended, and accruing interest and late charges after the date of first publication of this notice of sale;

WHEREAS, the property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale. Any prospective purchaser should research the status of title before submitting a bid;

NOW, THEREFORE Wells Fargo Bank, N.A., as the Mortgagee, will have the Mortgage foreclosed as by law provided by causing the mortgaged property to be sold at public venue by the Sheriff or Deputy Sheriff in and for Uinta County, Wyoming to the highest bidder for cash at 10:00 AM o’clock in the forenoon on 03/17/2021 at the Uinta County Courtthouse Information Desk located at 225 9th Street, , Evanston, Wyoming, Uinta County for application on the above-described amounts secured by the Mortgage, said mortgaged property being described as follows, to-wit:

Lot 50A and part of Lot 50B of the Twin Ridge Subdivision No. 2, being located in the City of Evanston, Uinta County, Wyoming, according to the plat recorded May 6, 1981 as Instrument No. 366190 and Correction Affidavit recorded January 19, 1984 in Book 458, Page 260, in the office of the Uinta County Clerk, with that part of Lot 50B lying East of the following described line:

BEGINNING at the Northeast corner of said Lot 50B, running thence S 3°18’30” E, 19.94 feet along the Easterly line of said Lot 50B; thence S 86°42’ W, 0.63 feet, more or less, to the center of an existing wall; thence S 3°00’ E, 38 feet, more or less, along the centerline of said existing wall to the South end of said wall; thence N 86°42’ E, 0.83 feet, more or less, to the Easterly line of said Lot 50B.
