NOTICE OF PUBLIC HEARING

The governing body of the City of Evanston will hold a public hearing to receive public comments on proposed modifications to the budget for fiscal year ending June 30, 2022.  The meeting will begin at 5:30 pm on Tuesday, March 1, 2022, in the City Council Chambers, 1200 Main Street, Evanston, Wyoming.

After the hearing, a resolution will be considered by the governing body to adopt the changes to the City of Evanston annual budget for fiscal year 2022.

Sealed bids will be accepted by the Parks and Recreation Department at Evanston City Hall, 1200 Main Street, Evanston, Wyoming 82930 until 2:00 p.m., Wednesday, March 16, 2022, and publicly opened and read aloud.

CALL FOR BIDS

City of Evanston: Avalon International Aluminum, LLC Facility

The City of Evanston (the Owner/Developer) is receiving lump sum sealed proposals for the Metal Building, Foundation, and Surface Improvements for a new Avalon International Aluminum, LLC Facility (the User/Client).  The work consists of the construction of a metal building system, foundations and site improvements at 1824 Union Road, Evanston, WY 82930.

First copies of the Contract Documents will be on file after February 8th, 2022 and open to public inspection in the office of the Owner, City of Evanston, 1200 Main Street, Evanston, WY 82930, and the office of Plan One/Architects, 4020 Dewar Drive, Suite A, Rock Springs, WY 82901. Paper plans and specifications will not be distributed. Bidders must obtain plans hosted by QuestCDN as managed by Plan One/Architects for a fee of $30.00.

A Pre-bid Conference will be held on February 23rd 2022, beginning at 2:00 p.m.  This meeting shall be mandatory for All General Contractors wishing to have their bid considered for the work. Attendees shall meet at the Project Site. It is also strongly suggested that this conference be attended by all Pavement Contractors wishing to participate.  All additional sub-contractors and suppliers are welcome to attend the pre-bid conference.

All proposals must be accompanied by a Bid Bond or Cashier’s Check in the amount of five percent (5%) of the maximum amount of the proposal.  The successful bidder shall provide a 100% Performance and Payment Bond.  Preference will be given to Wyoming Contractors as defined by Wyoming Statutes Section 16-6-101, et seq.  Bidders are required to comply with all applicable local, state, and federal laws. 

The Owner reserves the privilege of rejecting any or all proposals, or waiving any irregularities or formalities in any proposal in the bidding.  Submit written proposals to: Community Development, City of Evanston, 1200 Main Street, Evanston, WY 82930.  Sealed proposals shall be marked “Metal Building, Foundation, and Surface Improvements for a new Avalon International Aluminum, LLC Facility” and shall state the name of the company bidding on the outside of the envelope.  Proposals must be received by March 11th, 2022 at 10:00 a.m.  Proposals will not be accepted after this date and time.

NOTICE OF PRE-HEARING CONFERENCE

RELATING TO WATER RIGHTS

Docket No.s Amended IV-2021-3-10, Amended IV-2021-3-11, Amended IV-2021-3-12

IN THE MATTER OF the amended petitions filed by the CCN 2 Trust, before the Wyoming State Board of Control, for a CHANGE IN POINT OF DIVERSION and MEANS OF CONVEYANCE and VOLUNTARY ABANDONEMENT for portions of the following appropriations of irrigation water in Uinta County Wyoming:

Amended IV-2021-3-10: Change of Point of Diversion and Means of Conveyance of a portion of the Goodman Land & Cattle Company Appropriation, a Territorial Appropriation adjudicated under Proof No. 8870, diverting from Mill Creek through the Goodman-Cunnington Ditch, with a priority of 1878.

Amended IV-2021-3-11: Change of Point of Diversion and Means of Conveyance of a portion of the Goodman Land & Cattle Company Appropriation, a Territorial Appropriation adjudicated under Proof No. 8871, diverting from Mill Creek through the Goodman Territorial Irrigation No. 2 Ditch, with a priority of July 25, 1883.

Amended IV-2021-3-12: Voluntary Abandonment of a portion of the Goodman Land & Cattle Company Appropriation, a Territorial Appropriation adjudicated under Proof No. 8871, diverting from Mill Creek through the Goodman Territorial Irrigation No. 2 Ditch, with a priority of July 25, 1883.

 If successful these petitions would change the point of diversion and means of conveyance of a portion of the Goodman –Cunnington Ditch and the Goodman Territorial Irrigation No. 2 Ditch to a Point of Diversion upstream to the Mill Creek Diversion of the Lannon Ditch (an existing point of diversion not currently recorded in the State of Wyoming).  This series of petitions would also abandon water rights inundated by a reservoir.  

Said petition and map are on file with accompanying submissions at the central office of the State Board of Control in Cheyenne (777-6327), with a partial set of copies available for review at the Cokeville location of the State Engineer’s Office (279-3441).  Questions about the reasons for which the series of petitions has been filed may be addressed to the petitioner’s agent Fred Coles with Wasatch Surveying (307-789-4545). 

Said petition has been referred to the undersigned for a hearing as provided by Wyoming Statutes §§ 41-3-114 & 41-3-104, the Wyoming Administrative Procedure Act (Wyoming Statutes §§ 16-3-101 through -115), and the Regulations and Instructions of the State Board of Control and the State Engineer.

NOW THEREFORE, a pre-hearing conference shall be convened on March 31, 2022 beginning at 9:00 A.M.  at the State Engineer’s Office at 115 Park Street Cokeville, Wyoming, at which time the petitioner and anyone whose water right might be affected by the granting of said petition may appear telephonically (by calling 1-877-875-6073) and become a party to these proceedings.  Interested parties may alternatively attend the conference in person in Cokeville.  Attorney representation is allowed, although not required, but without an attorney a party can generally only represent himself or herself.

If you wish to protest, you must appear by telephone or in person at this pre-hearing conference.  Failure of any interested person or entity to appear at this pre-hearing conference will foreclose any future opportunity to object or appear in this matter and may result in action which may adversely affect that person or person’s water rights interest. If protests are received at the prehearing conference, a contested case hearing will be scheduled. At the contested case hearing any party protesting the petition should be prepared to identify their water right(s) and show under oath and subject to cross-examination how the proposal would affect their water right(s) if the petition is ultimately granted by the Board of Control.
