The governing body of the City of Evanston will hold a public hearing to receive public comments on proposed modifications to the budget for fiscal year 2022.  The meeting will begin at 5:30 pm on Tuesday, December 21, 2021 in the City Council Chambers, 1200 Main Street, Evanston, Wyoming.

After the hearing, a resolution will be considered by the governing body to adopt the changes to the City of Evanston annual budget for fiscal year 2022.

FORECLOSURE SALE NOTICE

EVANSTON CITY COUNCIL

First Regular Meeting

December 7th, 2021

The official record of proceedings of the first regular meeting of the Evanston City Council for the month of December was held in the Council Chambers of City Hall on the above date.  These proceedings were video recorded.

Council member Welling led those in attendance in the Pledge of Allegiance to the Flag.

The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, Tib Ottley, Evan Perkes, David Welling, Mike Sellers and Mikal Welling. 

Staff members present at the start of the meeting were:   City Attorney, Dennis Boal; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Public Works Director, Gordon Robinson; Police Chief, Michael Vranish; Director of Engineering and Planning, Dean Barker and Senior Planner, DuWayne Jacobsen.  Community Development Director, Rocco O’Neill and Director of Parks and Recreation, Scott Ehlers were excused.

Council Comments

Council member Sellers reminded everyone that December 7th is Pearl Harbor Day and to express gratitude to World War II veterans as they are responsible for our 60 years of freedom.  Mayor Williams thanked Council President Ottley for filling in for him at the Winter Meeting, he had a funeral to attend and regrets missing it.  He expressed gratitude to everyone that helped with the meeting.

Public Hearing/Liquor License

City Attorney Dennis Boal conducted a public hearing to receive public comment regarding an application for a transfer of ownership of a Retail Liquor License from Wyo Gastro, LLC, dba:  The Pub at Purple Sage to Evanston Golf Club, dba:  Evanston Golf Club located at 403 Kindler Drive.  No one addressed the issue, and the hearing was closed.

Transfer of Retail Liquor License/Evanston Golf Club

Council member Welling moved, Council member Perkes seconded, to approve the transfer of ownership of a Retail Liquor License from Wyo Gastro, LLC, dba:  The Pub at Purple Sage to Evanston Golf Club, dba:  Evanston Golf Club located at 403 Kindler Drive The motion passed unanimously with 7 yes votes:  Williams, Lynch, Ottley, Perkes, Welling, Sellers, M. RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR THE CONSTRUCTION OF 6TH STREET OVERPASS IMPROVEMENT WITH THE WYOMING DEPARTMENT OF TRANSPORTATION.

Public Participation

Evanston Citizen Fred Zech addressed the Mayor and Council regarding cell phone use while operating a vehicle. They discussed the pros and cons of an Ordinance.  Mr. Zech commented that he has spoken to leaders from communities that have ordinances in place.  They reported that they are easy to enforce.  He expressed that he thinks it is a problem in our community and would like to see a similar ordinance passed here.

The Uinta County Commissioners met in regular session on December 7, 2021 in the commission chambers, 225 9th Street, Evanston, Wyoming.  Chairman Eric South convened meeting at 2:00 p.m. Commissioner Brent Hatch and Commissioner Mark Anderson were present.  Also present: Amanda Hutchinson, County Clerk.

Motion Hatch, second Anderson to approve the agenda amended to include:  Carl Larson with a topic, Gary Welling with an item, and Amanda Hutchinson with an Executive Session.   3 yes votes, passed.

Homeland Security Grants

Motion Hatch, second Anderson to approve an agreement with the Wyoming Office of Homeland Security for $153,000 for the addition of a security fence at the Uinta County Detention Center as requested by Kim West, Emergency Management.  3 yes votes, passed.

Motion Anderson, second Hatch to approve an agreement with the Wyoming Office of Homeland Security for $59,455 for the installation of a concrete pad, other allowable equipment, and installation costs of a generator at the Human Service building as requested by West.  3 yes votes, passed.

Fort Bridger Airport

Motion Anderson, second Hatch to approve the Federal Fiscal Year End reports for the 3 open grants at the Fort Bridger Airport as requested by Kimberly Silvester, JUB Engineers.  3 yes votes, passed.

Motion Hatch, second Anderson to approve the renewal of Task Order #45-22-006-001 with JUB Engineers, Inc. for engineering services at the Fort Bridger Airport for an amount not to exceed $10,000 for calendar year 2022 as requested by Silvester.  3 yes votes, passed.

2022 Holiday Schedule

Direct Deposit Resolution

Forest Service Letter

Motion Anderson, second Hatch to authorize Chairman South to sign a letter to the Forest Supervisor of the Ashley National Forest requesting that Uinta County be granted “Cooperating Agency” status for the purpose assisting in efforts to develop the Forest Plan Revision for the Ashley National Forest as presented by Carl Larson.  3 yes votes, passed.

County Road Realignment

FORECLOSURE SALE NOTICE

WHEREAS, default in the payment of principal and interest has occurred under the terms of a promissory note (“Note”) and real estate mortgage (“Mortgage”).  The Mortgage dated January 8, 2016, was executed and delivered by Steven Lee Cluff (“Mortgagor(s)”) to 1st Bank, Division of Glacier Bank, as security for the Note of the same date, and said Mortgage was recorded on January 15, 2016,  at Instrument No. 1013290 in Book 1033 at Page 469 in the records of the office of the County Clerk and ex-officio Register of Deeds in and for Uinta County, State of Wyoming.

WHEREAS, the Mortgage contains a power of sale which by reason of said default, the Mortgagee declares to have become operative, and no suit or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part thereof, nor has any such suit or proceeding been instituted and the same discontinued; and

WHEREAS, written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and the party in possession of the mortgaged premises at least ten (10) days prior to the commencement of this publication, and the amount due upon the Mortgage on the date of first publication of this notice of sale being the total sum of $5,967.65 which sum consists of the unpaid principal balance of $4,372.08 plus interest accrued to the date of the first publication of this notice in the amount of $195.69, plus other costs in the amount of $1,399.88, plus attorneys’ fees, costs expended, and accruing interest and late charges after the date of first publication of this notice of sale;

WHEREAS, the property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale. Any prospective purchaser should research the status of title before submitting a bid;
