WHEREAS, the Mortgage contains a power of sale which by reason of said default, the Mortgagee declares to have become operative, and no suit or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part thereof, nor has any such suit or proceeding been instituted and the same discontinued; and

WHEREAS, written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and the party in possession of the mortgaged premises at least ten (10) days prior to the commencement of this publication, and the amount due upon the Mortgage as of November 6, 2019 being the total sum of $216,868.98, plus interest, costs expended, late charges, and attorneys’ fees accruing thereafter through the date of sale;

EVANSTON CITY COUNCIL

First Regular Meeting

November 5, 2019

The official record of proceedings of the first regular meeting of the Evanston City Council for the month of November was held in the Council Chambers of City Hall on the above date.  These proceedings were video recorded.

Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag.

The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Councilmembers Tim Lynch, Tib Ottley, Evan Perkes, David Welling, Mike Sellers, and Mikal Welling. 

Staff members present at the start of the meeting were:  City Attorney, Dennis Boal; City Clerk, Nancy Stevenson; City Treasurer, Trudy Lym; Community Development Director, Rocco O’Neill; Director of Engineering & Planning, Dean Barker; Public Works Director, Gordon Robinson; Director of Parks and Recreation, Scott Ehlers; Senior Planner, DuWayne Jacobsen; and Police Lieutenant, Ken Pearson.   Police Chief, Jon Kirby was excused.  A  group of interested citizens were also present.

Council Comments

Councilmember Sellers thanked the Public Works Department for their help with water leaks by the Aspen Grove Town Homes.  He also wished the EHS Swim Team good luck at the state swim meet. 

Mayor Williams commented that the Holiday’s are quickly approaching and encouraged everyone to participate in the upcoming events.

Ordinance 19-08

Councilmember D. Welling moved, Councilmember M. Welling seconded, to pass Ordinance 19-08 on second reading.

ORDINANCE 19-08:  AN ORDINANCE APPROVING AND AUTHORIZING A ZONE CHANGE FOR PROPERTY IN THE CITY OF EVANSTON FROM MEDIUM DENSITY RESIDENTIAL-DEVELOPING AND PUBLIC TO MEDIUM DENSITY RESIDENTIAL-DEVELOPING, AS REQUESTED BY THE CITY OF EVANSTON AS OWNER OF THE LAND MORE PARTICULARLY DESCRIBED HEREIN.

Resolution 19-64

Councilmember Lynch introduced Resolution 19-64.  Councilmember Lynch moved, Councilmember M. Welling seconded, to adopt Resolution 19-64.

RESOLUTION 19-64:  A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF A SELECTIVE TRAFFIC ENFORCEMENT GRANT FROM THE HIGHWAY SAFETY PROGRAM OF THE WYOMING DEPARTMENT OF TRANSPORTATION.

Resolution 19-65

Councilmember Sellers introduced Resolution 19-65.  Councilmember Sellers moved, Councilmember Ottley seconded, to adopt Resolution 19-65.

Final Acceptance/Street Overlays Project

Councilmember D. Comments/Remarks

Scott Ehlers announced that the Golf Course will be open again while the good weather lasts.

Public Participation

Kayne Pyatt invited everyone to attend the 19th Amendment event on Saturday, November 16th at 6:30 p.m. at the Strand Theater.  Local women who have made a difference in our community will be honored..

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules, notice is hereby given of the Application of Questar Gas Company d/b/a Dominion Energy Wyoming (Dominion Energy or the Company), for approval to increase its distribution rates and charges for natural gas services by $3.5 million per annum and a rate of return of 7.46%.

Questar is a public utility as defined in Wyo. Stat. § 37-1-101(a)(vi)(D), subject to the Commission’s jurisdiction pursuant to Wyo. Stat. § 37-2-112. Dominion Energy currently has approximately 27,800 customers in Wyoming, including customers residing in the cities of Rock Springs, Green River, Kemmerer, Diamondville and Evanston. 

On November 1, 2019, Dominion Energy filed its Application requesting Commission approval of the Company’s request to increase its distribution rates and charges for natural gas services by $3.5 million per annum, a return on equity of 10.5%, an overall rate of return of 7.46% and associated tariff amendments, effective September 1, 2020.

The Company states that failure to obtain the rate of relief requested to eliminate the deficiency of $3.5 million per annum will result in inadequate rates of return that will adversely impact the financial integrity of Dominion Energy’s public utility operations and its ability to provide necessary utility service to its Wyoming customers.

The effect of the proposed rate increase on typical Dominion Energy General Service customers who use 90 Decatherms per year will be an increase of about $96.32 per year, or approximately 13%.

This is not a complete description of the Application.  Interested persons may inspect the Application at Dominion Energy’s office located at 1005 D Street, Rock Springs, Wyoming, at the Commission’s offices located in Cheyenne, Wyoming, during regular business hours, or at the Commission’s web site at psc.wyo.gov.

Anyone desiring to file a public comment, statement, intervention petition, protest or request for a public hearing in this matter must so file with the Commission in writing on or before December 6, 2019.
