NOTICE OF ACCEPTANCE AND FINAL SETTLEMENT FOR THE

BANK RESTORATION PROJECT AT BEAR RIVER STATE PARKAT

Notice is hereby given that the State of Wyoming, Department of State Parks & Cultural Resources, has accepted as complete, according to plans, specifications, and rules governing the same, the work performed under that certain Service Contract 05SC0278301 between the State of Wyoming, Department of State Parks & Cultural Resources and G.M. Stewart Corporation of Wyoming, whose address is P.O. Box 3180, Evanston, Wyoming 82931 for the work performed, materials, equipment, or tools furnished or used and services rendered for the substantial completion of the Bank Restoration Project at Bear River State Park, Bid 0205-E, at Evanston, Uinta County, Wyoming. The contractor is entitled to final settlement therefore; that the Department of State Parks & Cultural Resources will cause said Contractor to be paid the full amount due him under said contract on May 7, 2020.  The date of the first publication is March 27, 2020.

Second Regular Meeting

March 17, 2020

The official record of proceedings of the second regular meeting of the Evanston City Council for the month of March was held in the Council Chambers of City Hall on the above date.  These proceedings were video recorded.

Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag.

The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Councilmembers Tim Lynch, Tib Ottley, Evan Perkes, David Welling, Mike Sellers, and Mikal Welling.

Staff members present at the start of the meeting were:  City Attorney, Dennis Boal; City Clerk, Nancy Stevenson; City Treasurer, Trudy Lym; Director of Engineering & Planning, Dean Barker; Police Chief, Jon Kirby; Public Works Director, Gordon Robinson; Director of Parks and Recreation, Scott Ehlers; Senior Planner, DuWayne Jacobson; and Payroll/HR Specialist, Diane Harris.  Community Development Director, Rocco O’Neill was excused.  A  group of interested citizens were also present.

Council Comments

Mayor Williams and the Councilmembers encouraged everyone to support our local business’s as much as possible during this uncertain time. They also asked that everyone follow the recommendations provided by the CDC on the Coronavirus. 

Ordinance 20-04

Councilmember Perkes moved, Councilmember D. Welling seconded, to pass Ordinance 20-04 on third and final reading.

ORDINANCE 20-04:  AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 15-2., ASSAULT, AND SECTION 15-3., ASSAULT AND BATTERY, OF THE CITY CODE TO MIRROR THE LANGUAGE OF THE STATE STATUTES FOR THE CRIMES OF ASSAULT AND BATTERY.

WHEREAS, there is a need to amend Sections 15-2 and 15-3 of the City Code to mirror the language of the state statutes for the crimes of assault and battery; 

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT:

Section 1: Section 15-2 of the Evanston City Code is amended and re-enacted to provide as follows:

  • 15-2. Assault.

Whoever, having the present ability to do so, unlawfully attempts to cause bodily injury to another person is guilty of assault.  Bodily injury means a cut, abrasion, burn or temporary disfigurement; or physical pain;  impairment of the function of a bodily member, organ or mental faculty.

Section 2: Section 15-3 of the Evanston City Code is hereby amended and re-enacted to provide as follows:

  • 15-3. Battery.
  1. Whoever, causes bodily injury to another person is guilty of battery. Bodily injury means a cut, abrasion, burn or temporary disfigurement; or physical pain; impairment of the function of a bodily member, organ or mental faculty.
  2. Whoever, touches another person in a rude, insolent or angry manner is guilty of battery.

ORDINANCE 20-05:  AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING TO AMEND  SECTION 12-2., OF THE CITY CODE BY ADDING SUBSECTION L. TO MAKE IT POSSIBLE FOR THE COURT TO ISSUE GENERAL PENALTY FOR A CONVICTION INVOLVING VEHICULAR HIT AND RUN.

WHEREAS, Section 12-2 of the City Code has adopted and incorporated a number of state statutes which are part of  the Uniform Act Regulating Traffic on Highways; and  

WHEREAS, Wyoming Statutes 31-5-1102 and 31-5-1104 are two of the incorporated statutes which make it a crime for a person to hit or damage the vehicle of another and then leave the scene without providing the owner of the damaged vehicle certain written information; and

WHEREAS, there is a need to add a subsection to Section 12-2 to make it possible for the court to issue the general penalty for a conviction involving vehicular hit and run, of not more than six months in jail or a fine not more than seven hundred fifty dollars or both; 

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT:

Section 1: Section 12-2 of the Evanston City Code is hereby amended by adding subsection L. to read as follows:

  • 12-2. Certain provisions of Uniform Act Regulating Traffic on Highways adopted; where copies filed; amendments to adopted material.
  1. The penalty for a person convicted of 31-5-1102 and 31-5-1104 may be imprisonment for not more than six months or a fine not more than seven hundred fifty dollars or both.

Ordinance 20-06

ORDINANCE 20-06:  AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING TO AMEND  SECTION 1-5., GENERAL PENALTY, OF THE CITY CODE BY ADDING SUBSECTION C. TO ENABLE A DEFENDANT IN  MUNICIPAL COURT TO PAY OFF A FINE THROUGH INCARCERATION.

WHEREAS, Wyoming Statute 6-10-105 provides authority for a criminal defendant in state courts to pay off a fine though incarceration; and  

WHEREAS, there is a need to adopt a similar provision in the City Code to enable a defendant in municipal court to do the same; 

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT:

Section 1: Section 1-5 of the Evanston City Code is hereby amended by adding subsection C. to read as follows:

  • 1-5. General penalty; remedies generally; continuing violations.
  1. A person willfully refusing to pay a fine or costs may be imprisoned if the court determines that the defendant has an ability to pay, or that a reasonable probability exists that the defendant will have an ability to pay, until the imprisonment, at a rate determined by the court, but not less than fifteen dollars per day, equals the amount of the fine or costs, or the amount shall be paid or secured to be paid when he is discharged.

ORDINANCE 20-07:  AN ORDINANCE APPROVING AND AUTHORIZING A ZONE CHANGE FOR PROPERTY IN THE CITY OF EVANSTON FROM RURAL RESIDENTIAL TO LOW DENSITY RESIDENTIAL-DEVELOPING, AS REQUESTED BY BART HUTCHINSON OF THE LAND MORE PARTICULARLY DESCRIBED HEREIN.

WHEREAS, property owner, Bart Hutchinson, has filed an application with the Planning and Zoning Commission of the City of Evanston, Wyoming to change the zoning of the property described below from a a Rural Residential Zone to a Low Density Residential-Developing Zone; and 

WHEREAS, the Planning and Zoning Commission scheduled a public hearing for said application on February 3, 2020; and

WHEREAS, notice of the public hearing and application was published in a newspaper of general circulation and notices of the hearing were mailed to affected landowners pursuant to City Ordinance; and

WHEREAS, a public hearing was held by the Planning and Zoning Commission of the City of Evanston on February 3, 2020, to consider said application for a zone change; and

WHEREAS, after receiving testimony and evidence from the applicants, affected landowners and the public at large, the Planning and Zoning Commission voted to recommend to the governing body that it approve the zone change.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, THAT:

Section 1.  The request of the aforesaid property owner to change the zoning of the property described below, from a Rural Residential Zone to a Low Density Residential-Developing Zone is hereby approved and authorized. Said real property being more particularly described as follows:
